carried in Janesville kicked out of menards(WI Open Carry)

I was just headin for the door when a guy from "menards loss prevention" comes up to me half out of breath and lookin like he really did not want to approach me comes up. He mumbles something about it being against policy to carry in the store. I responded that it was not posted at the door and needs to be if that is their policy. He then says I need to removed it from the store for "the comfort of our customers". I say ok and start heading for the door. He asks why I am carrying and I simply respond that the constitution of the wi and the us assure me the right to carry and that wi requires open carry by law if exercizing carry. He asks if I'm law enforcement and I respond with no, and that was about the end of it. He followed me out the door and thanked me for being cooperative as if i t was unnexpected that I would be. I heard something about "it's not illegal" or something to that nature from someone as I was walking but really was't wanting to get stuck in a debate so kept on my way.

Wisconsin Carry, Inc. Chairman:

"I just got off the phone with Bill Worley, the assistant store manager at Menards in Janesville.

The staff at the Janesville store was unaware Open-Carry was legal in Wisconsin.

Menards DOES NOT have a policy against open-carry by law-abiding citizens so long a they are not behaving otherwise inappropriately and abiding within the law.

Mr. Worley advised me that kawisixer01 was doing nothing wrong and behaving completely appropriately.

The store management called Janesville police and Janesville police verified for the store management that Open-carry is LEGAL.

Mr. Worley advised me that we are welcome to carry in their store in the future (of course respecting all laws and behaving appropriately)

Menards is a Wisconsin based corporation and I'm happy to say that we are welcome to continue to patronize their store. Kawisixer, you are welcome to open-carry when you shop at Menards in Janesville in the future.

This really shows Judge Lynn Adelman with egg on his face. This situation occured on May 8th, 2010. Here we have Menards saying that they understand that open carry in Wisconsin is legal, and they have no problem with customers doing so.

On 11 May, 2010, Judge Adlelman issues a summary judgement which says in part:

“No reasonable person would dispute that walking into a retail store openly carrying a firearm is highly disruptive conduct which is virtually certain to create a disturbance. This is so because when employees and shoppers in retail stores see a person carrying a lethal weapon, they are likely to be frightened and possibly even panicky. many employees and shoppers are likely to think that the person with the gun is either deranged or about to commit a felony or both. Further, it is almost certain that someone will call the police. And when police respond to a “man with a gun” call, they have no idea what the armed individual’s intentions are. The volatility in such a situation could easily lead to someone being seriously injured or killed.”

I talked to a businessman who is a good friend in Milwaukee. He says that Menards is highly respected and is likely to be fairly conservative. For Menards, this is a smart business move. It really does make Judge Aldeman out to be foolish.

actually, I believe Adleman is correct...Although I escaped Wisconstan a dozen years ago, I know the name...

I can understand a small business being uneasy. If I owned a business and saw a person carrying a weapons, even holstered, in my establishment I would be very nervous.

It is a question of liability. In the small town I used to live in a businessman was in the bank depositing the day’s till and accidentally dropped his gun. It went off, shooting him in the leg. The resulting hospital bills bankrupted his business.

After that incident the bank’s policy was no guns in the the bank, period. They didn’t want to be sued if some bystander was injured or killed in a similiar accident.

Many retail employees confuse employee policy with things the customer can and can't do.

If someone walked in with a drawn firearm, I would indeed be uneasy.

But if someone walks in with a holstered firearm, I wouldn't be.

Anyone who walks in could be carrying a concealed firearm - in fact, someone who robs a store using a firearm usually initiates in one of two ways: (1) they walk in with a drawn firearm and get right to it (crackhead) or (2) they walk in with a concealed firearm and wait for their opportunity (seasoned stick up artist).

I haven't heard of, or seen any surveillance cam footage of, someone walking into a store with an undrawn, visibly holstered weapon and then proceeding to stick the store up.

I’m talking about lawsuit liability resulting from an accident involving a firearm. It is a whole different problem for a business owner.

It should be the problem of the person carrying carelessly, not the owner of the premises unless the person is an employee, but then that is a measure of the need for tort reform.

Sounds like the good Judge is advocating conceal carry - make it so then ya baffoon.. If everybody is soo scared of armed citizens..

I’d wager 70% of the customers in that store would support and weren’t bothered in the slightest.

I don’t think so. The wording is right out of the Brady play book. They have been trying to de-legitimize guns for 70 years. Now they see it all slipping away...

I see what you mean. There was a guy that pulled up to my bank put his car in neutral, no parking brake and it rolled into another car.
The bank should have made a rule that no one can come to the bank by car or at least shut down their drive up.
