Time To Wrest The Reins Of Control From Congress - Constitutional Convention ???

Does anyone think it is time to restore some sense of order to the United States ??? I do.

The two-party system has fostered a climate where legislators have become beholden to their party at the expense of those that they represent - their constituents.

The Constitution is a GREAT document, but it is not perfect. And there are some housekeeping chores that are needed to clean-up some deficiencies in the document. After all, it was written over 200 years ago - and the Founding Fathers could never have imagined the mess we are in now.

However, they did leave us with one thing - the Constitutional Convention. It rips the Constitution out of the hands of Congress and places with the States.

I did not post it as the title of this thread, as the author is absolutely AGAINST the Constitutional Convention. He does, however, provide information on its current status.

As of this time, there are 22 states that have called for it, 18 that have never voted for it, and 10 who voted - but later rescinded it.

It only takes 34 states to FORCE Congress to call one. Of the 10 states that rescinded, I think that all 10 would be inclined to re-instate [if only to repeal the healthcare law].

That leaves 2 states of the 18 that have never voted for it to be turned. Kentucky, Ohio, and West Virginia look like candidates to me.

What do you all think ???

Wait and see what 2010 elections bring. If we can eliminate the Acorn Accounting System, we might be able to pick up some seats. Now I want you to consider one thing, and before you start yelling and screaming let me tell you why I think this. Our only chance in 2012 is to have a candidate, that understands the workings of Washington. Someone that knows where the bodies are buried, and who buried them. Someone that has more skinny on the Washington in crowd. Now I love Sarah, I think she has lots of spunk, she is well spoken, she says the right things. But I am sorry to say, she does not have the moxie to wrangle with the Washington Crew. Now sit down, take a deep breath, and think about it. who can carry the ball for us. Yep, Newt. Although lots of people have what they consider a legitimate gripe against Newt, he is still the one, that can get things done.He has a little baggage but compared to the Present Tenant of the White House, he looks like Snow White.

Newt has less chance of getting elected than Sarah. I guess you don’t remember, he left Washington with his tail between his legs. During the impeachment fiasco the libtards dug up some lobbyist honey that was giving him BJs in his office and then the deal with his divorce and other sorts of sexual stuff. I don’t know if any of it was true, but there it is. The Brown SHirt Media will pick right up where they left off with him the minute he starts to gather momentum. Now someone with Newt’s doggedness and determination, but in a skirt...well they may have a little more trouble finding someone who was givning HER BJs in her office, if you get my drift.

It depends on who would be attending. If there are 38 conservative Republican dominated legislatures who would be attending.

A signed written contract to clarify the only issues to be addressed: that health care is a state’s jurisdiction, define NBC, and specify that a fetus is a citizen and entitled to all the priveleges of same, it could solve some problems.

I am sick and tired of 20-30% of the radical people dictating what 70% of the rest of the people have to do.

Folks, please take a minute and read Article V. Just read the simple words there and think about where we are right now.

A lot of us agree that SOME changes to the Constitution are needed. Repeal of the 16th and 17th Amendments would be a good start.

OK ... let’s stop there. Repeal the 16th (income tax) and 17th (public election instead of state appointment for Senators) Amendments. How do we do that?

Is Congress going to propose the needed Amendment to repeal? Not likely. Congress loves the income tax. And the public election of Senators gives the states a smaller voice. Nope, they’ll never do it. So what alternative do we have?

If two-thirds of the states call for an amendment to repeal, they can demand a convention of the states to propose that amendment and Congress MUST convene one. And if Congress refuses to provide two-thirds support for the Amendment (which is probable) then the states can AGAIN override them.

Please ... Read Article V in its entirety.

If Congress won’t do what we want — ahem! — then the states can do it themselves.

I mostly agree we should wait until after November, but I’m not sure we can hold out that long. My gut tells me we’re in for a wild, insane, historic summer. The enemies of the Constitution are on the march and all bets are off. From amnesty to assassinations, anything is possible before November. Anything. Good luck.

Okay, well good luck. You are also not suppose to be able to pass a bill through reconciliation and make changes to it but, they did.

The 17th amendment was never fully ratified and fell short by two states and yet you are subject to it everyday.

Anything wrong with the current Constitution? I like it the way it is, though we should be hiring people who understand it and individual rights.

Incredible. You opine that you think the Constitution does not work as it should yet you like it the way it is.

Repeal the 16th, repeal the 17th and watch socialism die. I am serious about that.

Yeah, well i am down with repealing 16 & 17 but, the rest I am fine with.

I would also like to see a very narrow interpretation of the ICC and no more discussions about the general welfare clause.

Dump RICO, Patriot Act and narrow COLA and FISA.

But that’s just me.

I understand your intent but don’t feel it would go the way you think or the way I want.

The people who would be involved in Con-Con would not be serious Patriots, such as our founders.

They would be in it for ego, power and control.

Oh and by the way, I did not Opine the Constitution doesn’t work. Thanks for showing up and telling us all, like we are your children, the way it should be.

I imagine your attitude gets quite a bit of push back.

In terms of fair tax I was for it until I thought about it further and it would be a way for the government to bury their spending, so now I am not for it.

What I am for is making stakeholders out of everyone. Currently some 60% of America has no Federal Tax obligation and many times they get a check back from them(That’s us, the people who actually pay taxes and I pay more than most people make in a year).

If they were stakeholders and paying Fed Tax I might feel a little better this whole thing.

Don't call me a troll ... Have you EVER read my posts concerning "natural born citizen" and why BO is NOT one ??? I cite the REAL text of Calvin's Case, the British Nationality Act of 1730, and also the exceptions noted by Blackstone as to the definition of a natural born subject [ they are not limited to ambassador's children].

I posted about the Constitutional Convention for two reasons:

1. There are some areas of ambiguity in the Constitution that should be addressed. Such as the meaning of "eminent domain".

We here at FR know what the Founding Fathers meant [ the taking of property for the public good - roads, etc.]. But the Souter-led Court stated that private developers could grab the land because they would add more tax revenue to the community [Kelo v. New London]. Or do you want it to remain as is - and possibly have Starbucks knocking at your house tomorrow ???

2. The Constitutional Convention is a tool that the Founding Fathers left us. Just as the veto override was a guard against a tyrannical President, and just as SCOTUS are the guardians of the law, the Constitutional Convention is a guard against a tyrannical government [including SCOTUS]. It can accomplish what Congress, the President, and/or SCOTUS refuse to do - without their interference.

It is expressly difficult to call a Constitutional Convention [34 states have to agree]. And it is even more difficult to pass an amendment [38 states]. It is NOT something to be taken lightly.

So far the thread has from you:

That's just your retort to having been be caught with the foolish ‘the Constitution doesn't work, I like it that way’ nonsense.

And as I have become a scholar on the FairTax, and was a Flat Taxer before, I have seen your type of response numerous times and have researched it and found to be a false fear. That's Ok, not everyone will be won over, especially as it takes time to set in, but there are on average 800 new members to AFFT every day and the movement is the largest fastest growing reform movement in the United States.

I am here not to persuade you or anyone else. I am here to broadcast alternatives, to let people know there are other options, legal options, and educate persons that want to know more. When I come across hypocrisy or cowardice, I call that person on it, not so much to generate ill-will but rather to educate readers as to losing attitudes and unsound responses.

Once a seed of education of alternatives is planted, people will remember it when the time is right, they will remember the unfounded groundless objections to the alternatives, they will want to look for leaders that can put an alternative plan into action.

So if you don't like being called on hypocrisy, then I suggest you read your posts before you post them. If you feel you are being treated as a child, then I would suggest you get treatment for your feelings because your feelings belong to you and only you.

But you will be called on hypocrisy and false arguments whether you like it or not, and it's not for your benefit, it's for the benefit of those that will look back and remember the alternatives and the hypocritical responses to the alternatives.

And the hypocrisy is this:

“The Constitution has been subverted and is being subverted, it is being broken. Let it stay that way because the alternative of calling the grassroots to a convention to repair it and make it stronger will only destroy it. I do not trust the grassroots any more than I can trust the members of Congress and their tyrannical leaders. Therefore, I conclude without listening to full arguments that this alternative is unwise because I fear and have fear of uncertainty just as I fear the certainty of the destruction and subversion I see before me”.

And next I suppose you are going to ‘feel’ that the subversion and destruction should be met with conventional methods of elections although information is being broadcast that elections may end in the United States.

What I am trying to broadcast is there is a fallback position, position that frightens Obama and his people, a grassroots convention, which they cannot intimidate or manipulate in a powerful fashion. They are not prepared for it and it would take years for them to position themselves to control its outcome.

As the destruction and subversion continue, at some point those that are conservative and understanding of the freedoms they are losing, will ask what can be done? And they will remember there were those posts about an alternative with links to more information, written by Freepers who legal scholars and who have worked directly for Supreme Court justices, who were spending time to educate and were quick to call out those who appeared smug, complacent and hypocritical.
