The personal mandate is so profoundly and plainly unconstitutional, I would imagine that an injunction would be granted on that particular provision, pending a hearing on the merits of the case.
There are plenty of other provisions in which Constitutional infirmities may exist, but they're not quite as plain as the personal mandate, IMHO.
We do have to gird ourselves as some of it might survive - the excise tax comes to mind immediately.

So all of the whip counts we have seen are wrong. All the Republicans are lying. Obama basically cancelled his vacation with kids for some serious arm twisting. The fact that of the 37 Democrats we need 36 are pretty damn firm NO, with a couple dozen left out there to get ONE vote from. Any federal version of health care is unconstitutional since Article 1 Section 8 does not specifically grant Congress the power to regulate health care! The people are not bound to comply with any unconstitutional act of Congress! This is the point people need to hammer home with their Congress critters!

Personally, I think it will be 6-3, with Stevens joining the majority - assuming of course that Sevens doesn't drop dead first. In the last oral arguments they released on tape, he sounded like he was on death's door.

Then the Senate bills remains the effective law. Remember, Obama must sign this Senate bill that the House is “deeming” *before* the Senate can vote on the House reconciliation bill.
