Court rules 'no precedent' stopping voters from recall of U.S. senator
Tea partiers in New Jersey have moved one step closer to ousting a sitting U.S. senator that they say has shown "a total disregard for the people's wishes."
New Jersey Tea Parties United and the Sussex County Tea Party have joined forces to try an unprecedented way of sending a message to Washington: removing a senator through a recall vote.
A three-judge appellate panel ruled today that the New Jersey secretary of state must accept the tea partiers' notice of intent to recall Sen. Robert Menendez, D-N.J., and allow their joint recall committee to begin collecting the voter signatures needed to put the senator's name back on the ballot, two years before his term is supposed to end.
New Jersey is one of a handful of states that allows for the recall of its congressmen, thanks to a constitutional amendment New Jersey voters approved by a 3-to-1 margin in 1993.
Nonetheless, when the tea partiers filed to begin the recall process last September, New Jersey Secretary of State Nina Wells, under advisement of the state's attorney general, initially denied their notice, taking up the unusual argument that the state's constitutional amendment is unconstitutional.
Executing a recall of a member of the U.S. Senate "is a matter of exclusive jurisdiction of federal authority," Wells responded in an official letter. "Neither the United States Constitution nor federal statute provide for a recall proceeding for a federally elected official."
The tea partiers, however, then turned to the courts. "

There is no such thing as a "federally elected official."
Good news. Small victory. Some should be allowed to resign and go back to their families. Many should be recalled, prosecuted, incarcerated.
As I said in another thread about this, this is inherently flawed and will be thrown out because they did not go after Lautenberg too, who is more liberal and still in office for another 4+ years, 2 years longer than Menendez’s current term. The disparity opens the effort up to accusations of being racially motivated.
If the voters of New Jersey cannot wait two years to have a referrendum on Menendez, then they certainly can’t wait for 4 years to be rid of Lautenberg. By not going after Lautenberg as well, this group undermines their best arguments and rationale for the move, and proves there is no real urgency to their effort. Certainly not something that couldn’t want until the next election. It will be thrown out because of this disparity in treatment of the two senators.

What a stupid bit of reasoning: Senators are not elected by the federal gov but by the individual state which has the right and duty to set the rules of those elections. New Jersey in this case said that they could in fact do recalls. Wells is an idiot.

I get a little nervous about this stuff as well. There should be a process to remove these people but the bar needs to be set pretty high.
Liberals tried recalling my last congressman less than a week after he took office. The court let them collect signatures but they were stopped dead after that.
The Sussex Tea-Party was successful in getting the state to contradict it's own constitution and set them up for a badly needed smack-down. And THAT - is a thing of beauty.

My county is strange. Bush won both times, the last time he got 64% of the vote.
This time, 0bama got around (IIRC) 60% of the vote. How could anyone that had voted for GWB vote for 0bama?
I have two neighbors that supported Ron Paul, and when it was obvious he was going nowhere, took down their Paul signs and put of 0bama signs.
Shows total idiocy. Now one of them (haven’t talked with the other) hates 0bama. So maybe the 0bama schoolgirl crush fanclub frenzy was what got Merkely elected, and a lot of it has worn off now.
Seems my neighbor - and maybe others - actually believed the 0bama propaganda, and now is seeing more of what he is “really” like.
Merkley only won because of 3rd party vote splitting.
