Since Senators are chosen to represent the State, the State would have the implied right to recall any Senator which it believed was not properly representing the State in the Senate. In that case a vacancy would occur and the Governor would have the power to appoint a replacement until the next election.

While there is nothing in the Constitution authorizing a recall by the State, there is certainly nothing in there which prohibits a State from doing so.

In accordance with the intent of the Constitution, I think it is clear that the office does not belong to the Senator as an individual, but to the State as a collective with the individual Senator having the right to exercise the State's will in Washington. Therefore it would follow that if the Senator is not doing the job of representing the State, then the State would have the right to remove the Senator and replace him before the end of the term.

Speculating that Lautenberg is going to kick the bucket won’t hold up in court as a valid reason for a double standard. They have still undermined their own best rationale by not holding Lautenberg to the same standard as Menendez.

The argument that this is really just racially motivated will be a powerful one under the circumstances. These people are only going to bring disrepute upon the Tea Party movement.

Ah. I was so focused on 0bama that I didn’t follow the Senate election that closely. I just voted for the R, can’t even remember who it was.

What no firing squad? I'm thinking after a proper trial and conviction for treason that the back benchers get to dig the hole (hard labor), and the dem leaders fill it in (bang).

If I recall correctly there was a movement afloat in Arizona to recall John McCain in 2001. Then 9/11 happened and the recall was dropped for the sake of uniting a wounded nation. How different the 2008 elections might have turned out if he had not been our candidate.

From the article: New Jersey is one of a handful of states that allows for the recall of its congressmen, thanks to a constitutional amendment New Jersey voters approved by a 3-to-1 margin in 1993.

If FL doesn’t now have such a provision in its state constitution, you could begin working with a group to get the provision on the ballot, or follow whatever procedure is in place in FL to amend the state’s constitution. Every state should offer its citizens that opportunity when they are so poorly represented.

At the first number below you must wait through a tape recording urging you to tell your Rep or Senator to vote “yes” for the health care bill. Just hang on and when the recording is over, you will get the Capitol operator. Just ask for your Rep or Senator’s office. Then you will either talk to an aid or have the chance to leave a message for him/her to vote NO on the health care bill.

When you use the second number and the Capitol operator comes on, just ask for your Rep or Senator’s office. Every time I use this number I get the Rep or Senator’s answer machine, so it may be set up that way all the time...to go to their answer machine. Either way you can leave a message to vote NO on the health care bill!

We need to use these toll free numbers that have been set up for the health care/ BO supporters and illegals to use! After all they are FREE!

I get a little nervous about this stuff as well. There should be a process to remove these people but the bar needs to be set pretty high.

The manner of electing them is left up to the States. Since the Constitution is silent on removing - recalling them - it will be an interesting legal challenge. This ruling is a shot across the bow IMHO. And if SCOTUS upholds or refuses to hear the case, things could get quite interesting.

It is interesting that the legislators run to the constitution to tell us what isn’t in it as a means of saying that they’re protected by its absence.

Here’s an interesting article about Pete Hoekstra who has some recall legislation set to go. Also warns democrats about backing Americans into a corner. (I’m voting for him for governor)
