Interviewed on Fox just moments ago, Andrew Breitbart claimed that alleged Landrieu phone tamperer James O'Keefe "sat in jail for 28 hours without access to an attorney."
Breitbart, who has been on a public campaign defending O'Keefe, a paid contributor to Breitbart's BigGovernment.com, also charged that the U.S. Attorney's office in Louisiana leaked information to the press "helping" them to frame the episode as "Watergate Junior."
Breitbart complained that after the news of the arrests broke last Tuesday, O'Keefe's attorney and Breitbart himself were being called by the media but they could not locate O'Keefe -- "and that's because he was sitting in jail without access to an attorney," Breitbart said.
He accused the U.S. attorney of leaking information to the media in a "concerted effort" to frame the episode in a way that would put O'Keefe in a bad position.
Asked by Fox's Megyn Kelly what motivation the U.S. Attorney would have to make such an effort, Breitbart responded: "Well, it's tied to the Justice Department. And we've been very aggressive in asking Eric Holder to investigate what's seen on the ACORN tapes, and he's ignored it."

The difference being that, all other things being equal, if this had been Michael Moore trying to expose a Republican Senator, the media would be screaming about freedom of the press and repression of the reporter, and the Senator in question would be offering profuse apologies for the misunderstanding.

The one where it says in the AFFIDAVIT that says they dressed up in telephone repairman gear, went into a federal building stated that they were there to look at the phones and then commenced to looking at the phones. You think that’s ok? Would you mind it if I went to your house and did that?

If a Senator did that he would be spineless and the media is what it is. But if he committed something similar fine then he should be charged just the same.

All the "should be's" in the world butter no parsnips. As I understand it (and I'm a little closer to this, being in Louisiana) Landrieu's constituents were unable to reach anybody by phone at her office in the immediate prelude to, and aftermath of the "Louisiana purchase". O'Keefe and his sidekicks approached the office as phone service personnel, wishing merely to confirm (i.e. have somebody at the office confirm) that the phones were working properly, and capture the exchange on tape.
If this was Moore trying to "bust" a Republican or business CEO, or Borat just trying to make somebody look like an ass, there would not be any media coverage of this other than what a poor sport the intended target was being for not playing along. O'Keefe, and by extension Breitbart, have always been about exposing the double standard of the MSM, and are continuing to do just that.
