Terrorism Suspect Asks Judge to Dismiss Case

Lawyers for a terrorism suspect once held at Guantánamo Bay who is now facing prosecution in Manhattan asked a judge on Tuesday to dismiss his case on the ground that his nearly five years in detention denied him his constitutional right to a speedy trial.

A spokeswoman for the United States attorney’s office in Manhattan had no comment on the filing.

Guess these issues never occured to them. In fairness, the decision makers.

Clearly, if they are trying this case as if the terrorist is a criminal then his constitutional rights have been violated.

The Judge has no choice but to toss the case out. The terrorist should be walking the streets of New York next week a free man.

I understand that better than most, however I am pointing out something that is very obvious.
This speedy trial, being held with out their rights etc etc etc is fair game now and NEVER should have been allowed.

All it takes is one judge thinking how a “Non terrorist” would be treated an this is all over.

let me go one step further, and I am about the last one who would defend these people, but if the judge is not treating these people as “non terrorists” or “enemy combatants” Then where is the equal justice?

can you imagine anyone being held for say murder without their rights or a trial for 5 years in a county jail and not be granted this dismissal?

This is a show, staged brilliantly by Obama to undermine the security of the United States, give information to weaken our intelligence gathering efforts and put Bush / Cheney on trial for all the liberals to despise and pump up his base.

It has NOTHING to do with justice. Justice would be putting this guy in a burning building with no way out as he did to so many Americans in that embassy.

No I have never listened to Wilkow (im not in the loop apparently lol)But it just stands to reason that these simple things would be done by any lawyer. They had to see it coming.

And your right, everything that was gathered from KSM was duress, Obama already said he was water boarded. So any information he gave is inadmissible.

As i said in my last post, any judge that takes a look at this from a fair point of view, as in a non terrorist being held without trial for 5 years, what would they say? It was a speedy trial? No way. They couldn’t.

If they rule that this is, then they have opened the doors to the appeals court.

This is an orchestrated mess to make Bush look bad so the liberals don’t concentrate on what Obama is doing. Just keep their hatred up for Bush.

I know a lot of lawyers. They defend scum every day. Some do it because they want to see the jerks get off, but most just want to do their jobs. If they are assigned counsel, they have no choice, they can’t just not defend, nor can they do a bad job. They have to do the best that they can or it is a mistrial.

They have to defend the letter of the law like it or not. I don’t know these lawyers personally in this case. But I wouldn’t shoot down the whole profession in one swoop because they defend scumbags.. Of course this type of crime, you would have to seriously take your blinders off occasionally and wonder what the hell you are doing there.

Of course what did you expect from a man who authorized a flyover of Midtown for a photo op of air force one and not tell anyone?

When all is said and done and these terrorists—including the mastermind who came up with the idea to fly hijacked planes into our buildings—are set FREE, does Obama, Holder and the dems really think the American people are going to blame Bush for being so mean to the dastardly terrorists, or blame the very same dems who provided these known enemies of America and killers of OUR people a means to GET OUT OF JAIL FREE card???

You could make the case that “They want this to be a show trial on the Bush administration and have lent these SOBs the worlds media stage to spew their dung,” but really, regular people (and ones who vote) will see through this in a heartbeat.

What are these dems thinking????? This is suicide, plain and simple!!!! It will not idict Bush in anyway yet will make folks furious at Obama!!!!

I’m not so sure the answer is no. The Constitution guarantees the right to a speedy trial. I sure don’t want us to lose that right. If this man was a POW then different rules would apply. If the administration now thinks he is just a regular old criminal and should be tried in regular criminal courts, then his right was - at least on the surface - seemingly violated.

I was watching TV news (don't recall the channel, but it's irrelevant) and they had 'man on the street' interviews with New Yorkers of all kinds walking down 5th Avenue asking them what they thought about the terror trials being moved to NYC.

There were office worker people saying "I don't think they can get a fair trial here' and others like this one Vinnie in a ConEdison helmet saying 'Oh yeah, we;'ll hang 'em. You just watch' and all the other responses that you can probably imagine.

I was thinking to myself "This whole trial will be over long LONG before there's even a thought about jury selection".

Never mind the jury. Forget all about that. There's a defensive front line of screwball liberal judges that will intercept this entire terror trial case will decide the outcome without so much as one New Yorker receiving a summons for jury duty.

What you need to be hoping is that whatever judge derails the case and sets these animals free wasn't appointed by a Republican somewhere. That's all that will ever get talked about if that happens.

I can think up horror scenarios for this travesty of justice all night long...

Any lawyer that doesn’t ask for dismissal flat-out isn’t defending his client and the defendant could probably make a good case for overturn of the verdict based on lack of an adequate defense.

And that is why a diligent lawyer should not have presented the motion.

When the guilty as sin POS is subsequently convicted, instead of an iffy appeals process, there is a good chance of a 'do over'!
