Lawyers for a terrorism suspect once held at Guantánamo Bay who is now facing prosecution in Manhattan asked a judge on Tuesday to dismiss his case on the ground that his nearly five years in detention denied him his constitutional right to a speedy trial.

The result of unintended consequences perhaps. The Federal prosecutors have no comment on the situation. But now that Obama has opened this can of worms, the same will most likely apply to all terrorists held since President Bush including KSM in New York City

And so, the circus continues... Speedy Trial. Coerced Confessions (torture). Not Mirandized. Various rights violated while in detention.

This is way out of hand.

It’s time to take back the country.

Point is he (KSM) already plead guilty in a military court, now he can pull EVERY nasty trick in the book, get all kinds of publicity, motivate terrorists and give up our play books.

Obama’s “justice” department must have seen this coming and wanted it or they are just inept. But I can’t believe that they are that stupid! They would all be wearing dribble bibs for god sake.

I do. I thought they'd walk the minute Eric Holder announced that the trial was going to NYC.

The terrorist has a point, now that he's getting a civilian trial.

Doesn't he get bail too? How can they say he's a flight risk after sitting in a cell for five years? They have less reason to keep him in prison awaiting trial than they did with OJ Simpson.

I give it by this time next year he's schmoozing it up on 'Larry King Live'.

He has been charged with conspiring to help carry out Al Qaeda’s 1998 bombings of the American Embassies in Kenya and Tanzania, attacks that killed 224 people. The military has also said that he later served as a cook and a bodyguard for Osama bin Laden.”

As if we should even consider giving him a trial now.
I also thought it funny that the NY Times carried this story, I would think it for liberal persuasion and to blame the government for having taken away a basic right, but no where does it mention that this guy is not entitled to any rights as he was not a citizen of this country, nor was the crime committed here.

C. attacked Israel

...or some combination of the above.

Can you cite something -anything- of substance that he’s done that doesn’t fit A, B and/or C?

It’s goofy how this is always reported as “news”. There are certain times in court that a lawyer HAS TO ask for dismissal of the case, otherwise he CAN’T later. Any lawyer that doesn’t ask for dismissal flat-out isn’t defending his client and the defendant could probably make a good case for overturn of the verdict based on lack of an adequate defense.

I promise I’m not defending this POS terrorist or his skiffy lawyer, it is what it is. If it were up to me, this guy would already be dead with parts of his body jammed down his throat.

Great point. You must listen to Wilkow also.

The day after this was made news, Wilkow stated that BO and Holder had to be “in on it”.

There is now way a Ivy league grad and Colombia grad are that stupid. They want this to be a show trial on the Bush administration and have lent these SOBs the worlds media stage to spew their dung.

Every single bit of evidence gathered on KSM was taken under duress-thats all he has to say! He was NOT read his rights!

So whats the judge to do? I would dismiss and really throw the whole thing right smack dab back in the face of the idiots who started this son-of-a-bee-ery.

Ya know, I would really like to stay and talk about this but it really makes me sick. And I aint kidding either. Every time I think on this I feel that way.

Some 3000 people and their dependents and countless terminally ill firemen and police officers will have to watch as those responsible for what happened are about to get set free.
