Actually, this was one of the first things that occurred to me. How could he possibly take jurisdiction from the military tribunal?

It is quite possible that jurisdiction is going to be the thing that undoes all of this.

Holder didn't take jurisdiction away from anyone. This decision was made in the White House by the so-called "commander-in-chief," not at the Department of Justice.

That's why Holder was such a babbling idiot at the Senate hearing yesterday. He had no clue about any of the legal arguments, rationale, etc. for this move -- though I'm sure he was 100% behind it.

Does Obama have the authority to force the resignation or to fire Robert Gates? If he does, he will simply fire Gates and replace him with another lackey who will do whatever the zero tells him, legal, illegal, or unconstitutional.

Here's a question: Lacking an application for some kind of intercession can the USSC intervene on it's own to stop this?

If bummer and friends are smart they will bring this to the forefront in order to wiggle off the very sharp and poisonous hook they have impaled themselves on. Then they can tell their extreme tard supporters they tried. If ... they're smart ...

Fine with me as long as the ACLU doesn't get to go fishing through our intel agencies with the discovery process.
