Montana Governor Signs New Gun Law-(DARES Obama To Challenge it!)
Gather ^ | 5-5-09 | George W.

Posted on 05/06/2009 7:24:33 AM PDT by tcrlaf

The state of Montana has signed into power a revolutionary gun law. I mean REVOLUTIONARY.

The State of Montana has defied the federal government and their gun laws. This will prompt a showdown between the federal government and the State of Montana . The federal government fears citizens owning guns. They try to curtail what types of guns they can own. The gun control laws all have one common goal - confiscation of privately owned firearms.

Montana has gone beyond drawing a line in the sand. They have challenged the Federal Government. The fed now either takes them on and risks them saying the federal agents have no right to violate their state gun laws and arrest the federal agents that try to enforce the federal firearms acts. This will be a world-class event to watch.

Montana could go to voting for secession from the union, which is really throwing the gauntlet in Obama's face. If the federal government does nothing they lose face. Gotta love it.

Important Points - If guns and ammunition are manufactured inside the State of Montana for sale and use inside that state then the federal firearms laws have no applicability since the federal government only has the power to control commerce across state lines. Montana has the law on their side. Since when did the USA start following their own laws especially the constitution of the USA , the very document that empowers the USA .

Silencers made in Montana and sol in Montana would be fully legal and not registered. As a note silencers were first used before the 007 movies as a device to enable one to hunt without disturbing neighbors and scaring game. They were also useful as devices to control noise when practicing so as to not disturb the neighbors.

Silencers work best with a bolt-action rifle. There is a long barrel and the chamber is closed tight so as to direct all the gases though the silencer at the tip of the barrel. Semi-auto pistols and revolvers do not really muffle the sound very well except on the silver screen. The revolvers bleed gas out with the sound all over the place. The semi-auto pistols bleed the gases out when the slide recoils back.

Silencers are maybe nice for snipers picking off enemy soldiers even though they reduce velocity but not very practical for hit men shooting pistols in crowded places. Silencers were useful tools for gun enthusiasts and hunters.

There would be no firearm registration, serial numbers, criminal records check, waiting periods or paperwork required. So in a short period of time there would be millions and millions of unregistered untraceable guns in Montana . Way to go Montana !

Time to start a secession movement in FR. It is not treason when we are trying to reclaim the Constitution.

You must be new around here! It started on November 4, 2008!

At this point, I don’t see any blue helmets outside. I posted an article about two Utah legislators who are considering what Montana has enacted. The democrat, IMO, even had a reasoned statement... let’s see what happens she said.

Excellent news! This is a great response to the massive federal government growth/intrusion.

Congrats to all Montanans! And best of luck against the Feds on this... Godspeed, and God’s blessings to all of you.

[Apologies in advance that this question may be a bit “off-topic”, and leads to another subject as well — only related in regards to Feds overstepping their bounds...]

I’m just curious: There isn’t still some type of Homesteading Law out in Montana is there??? (I know about a century too late for that, huh?) I have some relatives that moved there in the very early 1900s, their photo/postcard sent back home after they had built their home/cabin didn’t show a lot of joy (I’m reminded it’s hard to pose for a photo and smile back then though). What their faces did show was a tremendous amount of pride in what they had accomplished for themselves so far...

I’m probably looking back on this whole concept with a bit (alot) of “a simpler time” sentimentality — wishing we were truly still in a time where people willing to work hard could achieve their dreams. I’m reminded that without today’s technologies, and without the vast amount of wisdom my relatives had about surviving “on the land” (building a home, raising crops (clearing a field), animal husbandry, and how to get and keep food without benefit of a grocery store, or a refrigerator, would make it even HARDER on some of us than striking out on their own back then was... I know that the mothers and women did just as much work (even if different in some ways) than their husbands did to establish their homes/ranches/farms. [Is it any wonder that women first won the right to vote in Montana? That’s my theory on THAT at least! LOL]

At this point, although it’s still possible for people to be successful (at least in the manner of going to school, and getting some kind of ‘professional’ job), not as many are able to do so without degrees, and working for others, and this is directly due to the Feds and numerous state laws, and SO many regulations standing in the way of TRUE PROGRESS (which isn’t the “progress” spoken of by LIBERALS, even though they believe it is. Progress doesn’t mean radical abandonment of tried and true principles, it means IMPROVEMENT on an existing base of structure — and Socialism is not an IMPROVEMENT it is a BACKWARDS step!)

What I’d love to see Montana (and other states) tackle next in re: to the Feds? The proposed regulations regarding smaller family farms, “hobby” farms, and organic farms — especially the proposed federal regulations citing “food safety” that will effectively end “farmer’s markets” and road-side stands. All agricultural states should be SCREAMING about these proposed laws and regulations.

Back in Colorado we had the “Natural Law Party” as one of our recognized “minor parties”. While I disagreed with a great many of items on their platform they certainly had one part of the equation right — our government has no business forcing laws upon the people such as; genetically altered foods, blocking natural and alternative medicines (due to the feds close relationship with pharmaceutical companies) to the point where proven scientific research and development is blocked unless you have millions to go through the hoops required by the FDA, designating which types of SEEDS farmers and gardeners will be able to purchase (banning non-hybridized seeds that do NOT produce their own seeds at the end of their crop cycle). And, I could go on and on.

While I recognize the need for oversight, and regulation over food imported into this country from outside countries especially (like what we saw from the products from China — food products especially).

And, while I recognize a need for some oversight, in cases where large (corporate) food producers/farms here in the US may cut corners for profit thereby threatening the quality of their food, and safety and such. There is no reason for some of these laws that truly are ‘overkill’ here within the US — especially the ones that will effect even SMALL family and hobby farmers who CAN’T pay all these government fines and pay for whatever ‘codes’ they come up with that will allow them to sell their flowers, or tomatoes, or whatever they may bring to their local farmers’ market. [I don’t think that’s an unintended consequence either, I honestly think it’s a way for the government to support the special interests like — corporate food producers and farms — and basically destroy citizens’ abilities to provide for themselves, and their ability to maintain self-sufficiency by at times offering their goods to those in their communities for a small profit!]

I could make this a REALLY long post, but the gist of all of this is;

The states all need to start standing up against the oppressiveness of the Federal Government over the states — such as Montana has done with this “Reinstatement of Rights” Act. It may be hard at this point given how many rights the states have “let slide” till now, but it MUST be done.

Godspeed to all true American Patriots seeking to preserve the rule of law in this nation as supported by our U.S. Constitution. And, may God — according to the warning in Proverbs — allow the traps those seeking spoils lay for themselves, and those who wait with them to catch them up sooner vs. later.

The *point* is that Montana says that's not valid and is a dishonest unconstitutional interpretation of the commerce clause. And Montana says “ok, your move, what you going to do about it Kenyan?” If the feds push, Montana says their next move is to vote to secede.

Point made! And what a worthy point it is at that! And it couldn't happen to a more worthy Kenyan! Even the previous idiot in chief wannabee, Kerry wouldn't be pulling the stunts the Kenyan has!

Great in theory, but can Montana support itself if they did? They are landlocked, and lets face it, the Feds could overrun Montana pretty easy.

This won’t stand, as much as I would like it to. To make it stand would involve the Montana State Police arresting ATF agents going after someone who built or bought a firearm made under this law. And I doubt that would happen.

What does the militia part of the 2nd amend have to d with exercising your right to bear arms? Nothing.
In fact the 2nd amend states militias can be regulated.
The 2nd does state that the right of the people cannot be infringed.
And nowhere in the 2nd amend does it mention interstate commerce.

As Hiredhand has stated here before.........precedent ain’t set yet. Until a person is arrested by batfag’eees and state , county or local PD arrest them for violating this state law etc ........all speculation right now.

I like what the individual states are doing yet ....confidence is low.

It won't be the military (though they would if needed). The real test will be when the ATF/FBI or pick the alphabet soup agency comes in to arrest someone in Montana for violating the federal gun laws.

Would the Montana state government arrest the federal agents at the risk of an armed shoot out? Doubt it.

This won't stand guys. If you are in Montana don't fall for this and end up spending a lot time in a Federal pen being a martyr.

Haven’t Texas and Oklahoma suceeded as well?

If I heard right, the soverignty (spelling) issue has passed the Oklahoma House and on its way to the Senate. Also Oklahoma will vote in 2010 on making English the official language. You can count on the Okie voters to do it by a wide margin.

More federal laws - and agencies - are now dependent upon the “IC clause” than are dependent upon the actual constitution for their existence.

I noticed you forgot your < /s> tag, while I was trying to LOL.

Then I realized there was not meant to be a < /s> tag.

I ended up throwing up.

The books were printed and bound this week, and the pallets will be shipped tomorrow. One pallet of 900 books is coming to my house. To get ready, I’ve been doing a mass-addressing of mailers. Once the books arrive I’ll start signing and stuffing. Most of them might go out Saturday, if they arrive here Friday.

Might have to make Montana a future destination if Obama screws this country up more than he already has (and we all know he will).

Would be interesting if Montana breaks away and Alberta break off of Canada, "Athabaska Republic" anyone?

Montana won't be alone for long. Utah and Texas are considering passing this type of law. Also, California is considering legalizing marijuana in defiance of the Controlled Substances Act and Gonzalez v. Raich. Is the Liberal Messiah going to go to war against California, Utah, Texas, Montana and any other States which refuse to bow before Him, and His corrupt apostles in the Congress, like He did before the King of Saudi Arabia?

Actually, the supreme law enforcement in the area is the county sheriff.
