WASHINGTON -- President-elect Barack Obama's advisers are quietly crafting a proposal to ship dozens, if not hundreds, of imprisoned terrorism suspects to the United States to face criminal trials, a plan that would make good on his promise to close the Guantanamo Bay prison but could require creation of a controversial new system of justice.
During his campaign, Obama described Guantanamo as a "sad chapter in American history" and has said generally that the U.S. legal system is equipped to handle the detainees. But he has offered few details on what he planned to do once the facility is closed.
Under plans being put together in Obama's camp, some detainees would be released and many others would be prosecuted in U.S. criminal courts.

Laurence Tribe, a Harvard law professor and Obama legal adviser, said discussions about plans for Guantanamo had been "theoretical" before the election but would quickly become very focused because closing the prison is a top priority. Bringing the detainees to the United States will be controversial, he said, but could be accomplished.

This is the kind of stuff that needs to be trupeted loudly in the U.S. Only diehard liberals agree this should be done. Most Americans will recoil to hear that these murderers are going to brought here.
All it would take is one botched trial with one of these bad actors suddenly released on the streets of New York to make 75% of Americans suddenly regret the existence of Barack Hussein Obama.

They have no cohesive plan for any of the major problems the nation faces, but closing Gitmo is a TOP PRIORITY!!!!! (Yelling on purpose.)

Isn't this just the executive arm bowing gracefully to the inevitable? Already as a result of the June Supreme Court ruling on the case
Boumedienne et al v. Bush (PDF) docket number 061195, six Algerian-Bosnians detained at Guantanamo since October, 2001 have a habeas corpus hearing in progress in before a D.C. civilian court.
Dozens more are on the way (Boston Globe). It's a fait accompli. The detainees have prevailed in the courts on this issue.

It is a toss-up on this issue.
McCain advocated he would seek to close GITMO on Day 1 of his presidency and move the prisoners to Ft. Leavenworth.
IIRC, even McCain’s extended growth, Lindsey Graham, also says he would push for closing GITMO and moving the ‘detainees’ to US court jurisdiction.

In 2010, we'll have had two years to of a bad economy micro managed by an incompetent owned by the very unions which have chased most of our jobs overseas and who promises to bankrupt the coal industry. If we capitalize on that starting NOW, we've got a chance to make the congress more hostile to our "ruler".
