Obama to use executive orders for immediate impact

"There's a lot that the president can do using his executive authority without waiting for congressional action, and I think we'll see the president do that," Podesta said. "I think that he feels like he has a real mandate for change. We need to get off the course that the Bush administration has set."

Executive orders "have the power of law and they can cover just about anything," Tobias said in a telephone interview.

On drilling, the federal Bureau of Land Management is opening about 360,000 acres of public land in Utah to oil and gas drilling. Bush administration officials argue that the drilling will not harm sensitive areas; environmentalists oppose it.

"They want to have oil and gas drilling in some of the most sensitive, fragile lands in Utah," Podesta said. "I think that's a mistake."

He also said he’s a “citizen of the world” and has come to “change the world.” I’m certain that is his agenda.

His agenda will be complicated as to what we will openly be allowed to hear and see, but make no mistake his primary directive from his puppet masters are my tagline.

You are so right and he will have Pelosi and Reid to back him up. We didn’t just lose an election, we lost our country. I signed every petition for off shore drilling and clean coal and sent emails to my senators. I have letters from Dole and Burr and an email from Brad Miller. I’m in NC and in Jan. Elizabeth Dole won’t be there for us. I know they have a bill pending but it seems it was all smoke and mirrors now.

Fearless prediction:
ANY democratic members of Congress that oppose Obama, either individually or in a group, are going to get the “racist” label tossed at them very quickly. How DARE they oppose the first black president and the leader of their party? What else could that be, if not racism?

They will be shut up very quickly....

We have to stand and fight while we can. We have recourse in the US Senate and we have to make the GOP senators fear for their political lifes.

If we fail, the "fundamental change" Obama has been openly spouting will be upon us and we may face the same dire choices our founders did.

I don’t want to hear any b*tching from those that voted for Obama when gas prices skyrocket. I have a couple of relatives that voted for him, and you better believe they are going to hear it from me when prices go up, up, up.

He can always try. Bush did.

There's a pretty good summary of how EOs are used and abused in Wikipedia, here.

It's a sad indictment of Congress and the courts that there have been just two executive orders overturned by the U.S. courts to date, one issued by Harry S Truman nationalizing the steel mills and another by Bill Clintoon attempting to restrict federal contracting to "good" companies that don't hire strike-breakers.

Not mentioned in the Wikipedia article is that the courts routinely throw out cases brought by members of Congress for lack of standing.

Contrary to the above baseless assertion about executive orders by constitutionally clueless Tobias, the president has only those powers which are delegated to him by the federal Constitution, defined mainly in parts of Articles I and II. And as the Wikipedia page below shows, not only are executive orders not explicitly mentioned in the Constitution, but are evidently historically used by presidents as a basis to fire officials when they fail to carry out their orders. So much for the force of the law.

I also noted that President Truman got "busted" by the USSC for trying to use an executive order as if it was law. And then there's this line:

Presidents since this decision have generally been careful to cite which specific laws they are acting under when issuing new executive orders.
Hopefully, misguided rookie Obama and his advisors will ultimately be forced to admit that they learned all about constitutional limits on presidential powers after Obama became president.
