The Supreme Court Wins, America Loses

As the world has just learned, the Supreme Court of the United States ruled 5-4 yesterday that “for the first time in our Nation’s history, the Court confers a constitutional right to habeas corpus on alien enemies detained abroad by our military forces in the course of an ongoing war.” So summed up Justice Scalia in a stinging dissent in which he was joined by justices Roberts, Thomas, and Alito. Justices Kennedy, Stevens, Souter, Ginsburg, made up the majority Breyer.

What would happen if we just called them “Prisoners of War” instead of “detainees” ,, I never saw the reason for being cute with the terminology ... POW’s have always been held for the duration of a conflict and have never had rights to a lawyer....even when held on US soil as many German prisoners were in the southern US.

Yet, it is entirely within the bounds of the Law of Land Warfare to summarily execute terrorists on the battlefield at point of capture (if they are not in uniform and not a member of the organized military of the state with which we are at war = terrorists).

Why don’t we do this? Quite a message to send rather than offering full medical care, access to an Imam, free qu’ran, shower shoes and man-jammies with some pocket money upon release.

The Intel loss would be far outweighed by the impact on future fighter recruitment...

Heaven help us. May God save the republic.

Which party appointed these four?

Scalia - Reagan (R)

Roberts - GW Bush (R)

Thomas - GHW Bush (R)

Alito - GW Bush (R)

So ... as we wonder whether Justice Hillary will become a counterbalance elevating feelings above the rule of law ... does it matter whether we elect McCain or Obama?

McCain won also. He backed 4 of the 5 in their confirmation process who voted in favor of allowing foreign terrorists the same rights as American citizens, mah FRiend. McCain sure can pick ‘em.

Words fail to convey the monumental stupidity of both this decision, and the consensus idea that detainees had no redress whatsoever. The military tribunals were set up to include an appeals process for these ak-waving, American-hating, bomb-throwing dogs (no bias here...).

Nope, it won’t even phase these idiots if a released detainee shows back up on the battlefield....oh wait, that has already happened in the case of 30 or so tangos.

I recommend giving each terrorist a map of the DC area, with the houses of the SC justices clearly marked. Then “repatriating” them to the DC area.

McCain did not "pick" those justices, he approved the president's choices which was exactly what 90 plus denators did each time. McCain has never picked Justices and he would pick Justices like the four conservatives in the minority on this decision. As you should know, McCain has criticized the decision.

Failing to recognize that voting for McCain is essential to reversing this decision is, as my daughter says, an epic fail.

Approved/picked/selected/supported/ voted for...choose your semantic. It brings the same result and gives us a glimpse each time into McCain's liberal mindset.

As you should know, McCain has criticized the decision.

No he hasn't. He paid homage to Roberts as a form of political grandstanding. He threw a slider.

"These are unlawful combatants, they are not American citizens and I think we should pay attention to Justice Roberts' opinion in this decision," McCain said, referring to the chief justice's dissent. "But it is a decision that the Supreme Court has made. Now we need to move forward. As you know I always favored closing Guantanamo Bay and I still think we ought to do that."- McCain

Using the phrase "Paying Attention" is McCain's way of telling Roberts to sit down and shut up as respectfully as he can muster without stepping on his previous comments on how he "might" nominate future SCOTUS judges.

Call the White House comment line and tell the President to fight this decision.

Call your Senators and Congressmen, and tell them that this decision is unacceptable, and puts Americans in danger. They need to create legislation to correct it, and they have that responsiblilty and ability under the Constitution to do so.

And if anyone says that, well ,it is the Supreme Court and they have ruled, you tell them fine, then let’s fire you and your boss and let these nine unelected people run our lives.

No country does this, not one. I’d rather they get put on a plane and sent back to Iraq, Pakistan, or wherever and freed than have thm go through the Federal Court system with propaganda show trials. That will be a better recruiting tool than anything done to date for jihadi groups.

Take action. These yokels in DC are ruining this country and need to know who is in charge.

I guess that is because, technically, we are not at War. Congress — the lawmakers — never did a formal declaration, only an authorization of the use of force. We’ve been fudging the status of the ‘detainees’ since the beginning.

Osama, Obama, all the Liberal Democrat Partisians on the SCOTUS and all America Hating Dumbo-crats everywhere won another victory in their quest to destroy America.

Maybe Conservatives should just join the Muslims in creating a Draconian conservative society ruled by Sharia law. All good clean conservatives would have no problem. All Gay-Centrist Liberals would quickly be exterminated. Maybe we are looking at it wrong.... Maybe in the end we find out the conservative Islamofacists are our best friends... Doesn’t matter, cause the Islamofacists will win at this rate so the Liberals are screwed anyway which is the silver lining.

Until yesterday I was confident that the court would come down on the side of the 2nd amendment. Now, in my gut, I’m terrified that that silly, stupid old man Kennedy can be counted on to take rights from citizens at the same time that he gives rights to non-citizens.

This is an absolute discrace - a weak, pathetic decision that will tie up courts, cause more red tape, embolden our enemies, and place Americans in greater danger.

What a stupid decision by the Supreme Court yesterday - this issue will have to be revisited.

Yet another example of America suffering damage from the wickedness and incompetence of President William Jefferson Clinton.
