What is wrong with people nowadays?
Some of you may remember back in July of 2004 my niece Emma was seriously injured and had to have half her skull removed, along with half her brain. The Doctors and the Police determined that this was not accidental and charged my sisters boyfriend, who was taking care of her at the time, with 2 counts of aggravated child abuse.
Well the trial ended today and he was found not guilty on the first count which they said he had no criminal intent to injure my niece. Forget the fact that out of 18 expert witnesses only one said there was any possibilty of an accidental injury and it was an extreme possibility, essentially a 11 month old baby would have to stand straight up, no bent knees and hit a marble table in two spots on her head and 'bounce' 4 feet away!!
The second count they had found him guilty. This count was for taking an hour to do anything about Emma's condition, essentially he drove past 5 hospitals to get any help for her AFTER he noticed aginal(sp?) breathing sounds(the death breath.
When the Jurors were being polled by the Judge one of them changed there minds, and now its a hung jury!! When she was questioned afterwards she said he was too good looking to have done anything wrong, thats right forget the facts, he was too good looking to be guilty!!Oh yeah and she is an abuse counselor
I am mad now my sister has to go through another trial in a year or so and a child abuser will still walk the streets.
Jeeeeesh! Someone fell asleep at the switch! I can't imagine they let him loose.
Where did the trial take place?
Did this happen in AZ?
Sorry to hear that, makes a great case for professional jurors.
Yeah in Phoenix.
Phoenix
Every time I have anything to do with court I a reminded that no one is ever happy with the outcome. It is always a shame that things come to that.
I would expect this sort of justice in Minnesota. I guess I'm not up on the state of affairs in AZ.
Unbelievable. How is your niece doing?
I have absolutely no faith whatsoever in our judicial system. This story just confirms for me that I am totally in the right for feeling this way.
I wouldnt have been happy if it was both non-guilty thats for sure, but I wouldnt be as po'd as I am now knowing that a juror changed there vote after she voted guilty while she was being polled, and for the asinine reason she chose to say. The first one I can live with because intent was a big deal since the Prosecutor didnt pick any lesser charges for the jury to fall back on.
Is there a link where we can read media coverage of this crime in addition to the personal narrative you've provided?
~ Blue Jays ~
I am sorry you and your family have gone through this. How is Emma doing?
Our justice system is the best system out there, which is scary when you realize that it sucks rocks.
Best wishes to you and your family.
Well she is ok, she will never walk, have full coordinationor see out of her right eye or even have full cognitive abilities though.
For those of us who were not around in 2004, will you please tell us how Emma is doing ... if it is not too painful to post about.
Blessings on your whole family.
Too good looking for prison. Gee, where have I heard that one before? Makes me sick that people can't see past "looks" to know an evil person when they see one. Disgusting.
Our judicial system is "Let's make a deal." The whole thing is loaded is socialist lawyers and complete idiots in black robes. They will do the wrong thing most of the time because their views are upside down.
The Bible says "Woe to thee that call evil good and good evil. " That about somes up our stupid kangaroo courts.
Unfortunately there isnt, that I know of. Usually a case like this gets media attention down here, especially since the perp is in law enforcement(or was).
