MADISON A lawmaker pushing a statewide smoking ban that would pre-empt local rules by allowing people to light up in bars and certain restaurants says time is running out for action.
While he doesn't consider the bill dead, Sen. Scott Fitzgerald, R-Juneau, said he doubts it will get passed this year.
"I've been around the building long enough to know that, until session is over, it's not over," Fitzgerald said late last week. "I will say this, the votes were not there to bring it to the floor this past fall and it still remains (at the committee level), because I don't know that the votes are there now."
The uncertainty comes despite a compromise proposed to lawmakers recently by the Tavern League of Wisconsin that would allow cities like Appleton and Madison to keep existing bans that prohibit smoking in all workplaces, including taverns.
The state bill, co-authored by Fitzgerald, stalled in the Senate after the Assembly endorsed the ban in June. Opportunities for action would be limited after the legislative floor period ends Thursday.
Appleton voters will decide April 4 whether to overhaul the city's ban, including providing an exemption for bars and bar areas of restaurants.
If the statewide measure were changed to incorporate the Tavern League's compromise and the Senate approved, the bill would need to go back to the Assembly.
The vote in June was 48-45.
Our own radical RINO lawmakers are also jumping on the band wagon to put the screws to their smoking constituents. Can't trust none of these idiots!
While this is very good news, I'd still rather they'd ZOT these bills because they're based on a fraudulent SHS study.

Thankfully, business owner's are waking up to the sad situations their fellow brothers are in trying to make a go of it in smoke free states.
