I might be wrong but I could swear I heard this late yesterday or crack of dawn this AM. Doesn;t make it old news, of course, but all day I am waiting for the final determinator by the terminator, so I picked this court decision up somewhere long ago. No big deal (except for tookie that is) Maybe someone can post a timeline on it.

Thanks, Bunny. I think Arnold has been waiting to hear what the court would decide. If they had decided to allow a "stay of execution", Arnold would be off the hook, so to speak.

Yu know the guy who played Billy in that flick also announced that he was running for governor of Kentucky several years ago? Then it came out he had a couple of run-ins with the law for domestic violence and he dropped out.

Well, excuse me; Fox just announced it as Breaking News from the AP.

It was breaking news. CalSC denied appeal earlier today, 9th Circus Denied appeal a long time ago and just DENIED the appeal of the CalSC decision.

They will now go to SCOTUS and be denied there for a third time.

My hunch is that Arnold will decide for one of these two options:

1) Deny clemency for Tookie after a long statement where he discusses all the circumstances and previous limited use of clemency and then says it's not the role of the governor to overrule the courts and the decisions of juries, or

2) He can't cope with the idea of deciding to let a man die and decides to do what Gov. Rion did in IL and grants clemency to everyone on death row. This would be a sweeping grand gesture to try to be the "people's governor," justified by a statement that there are too many uncertainties and possible errors in the evidence and the witness testimony in all of these death penalty cases. This would only happen if Arnold doesn't really care that much if he wins his reelection campaign, because this decision would surely hurt his reelection bid.

He'll probably choose option 1 with great reluctance.

I doubt it, he and Sen. Byrd are similar that way. Byrd says he carries a copy of the constitution in his suit jacket everyday, and I am positive that he has't read that!

Only the government is authorized to put someone to the death penalty. We the people have establishedfe guards over that process. Juries make mistakes. The clemency process is a way to remedy that.

Yet, you and some other freepers who desire to either see him fry or see liberals lose don't have the patience to allow the process to occur. You want to turn the process into one about who can send the most emails. Frankly, that isn't a world i desire nor most rational beings would want.

"Warden, this is the Governor. I have great news for Tookie. I just saved a bunch of money on my insurance at Gekko!"
