Bush narrows Supreme Court selection to 2, sources say(great picks IMHO!!!)

WASHINGTON - Rebounding from the failed nomination of Harriet Miers to the Supreme Court, President Bush is poised to select between two of the nation's leading conservative federal appeals court judges - both experienced jurists with deep backgrounds in constitutional law - for what promises to be a bruising Senate confirmation battle.

With an announcement expected Sunday or Monday, administration officials have narrowed the focus to Judges Samuel Alito of New Jersey and Michael Luttig of Virginia, sources involved in the process said. Both have sterling legal qualifications and solid conservative credentials, and both would set off an explosive fight with Senate Democrats, who are demanding a more moderate nominee to replace Justice Sandra Day O'Connor.

...Bottom line is that we should have at least 51 Republican votes for the nominee whoever he/she is as long as the conservative credentials are rock solid...

And it gets better, because I think will get a bunch of Democrats too... in red states... very likely.

Too bad indeed. I'll still vote for him for AG or whatever it is he's running for.

If someone would declare against him, DeWine would be guarenteed to lose the primary. As is, his chances of re-election are chancy already given conservative hostility.

Since Kasich, my choice, won't do it do you think Bob McEwen could get beyond his baggage aka the "boucin Bob" nickname he earned as part of the House Bank Scandal. Barbara Boxer abused it more than he did. The religious right loves him and they are big in Cincy? What's your take on McEwen primarying DeWine?

Also, Clarence Thomas and John Roberts would be thrilled with Luttig joining them as they are both friends of his.

Thats an understatement.

Luttig and Roberts are best friends and Luttig was either the best man or one of the ushers for Roberts wedding.

Luttig is also very very close with Scalia.

If Luttig gets on, the 4 of them will be beyond happy.

Alito is widely perceived as easier to confirm than Luttig, but on the abortion issue he could be more controversial. He wrote a dissent in a 1991 case that would have upheld a Pennsylvania law requiring women to notify their husbands before obtaining an abortion unless they were worried about their safety or believed the husband was not the baby's father.

I don't think that's a liability at all with public opinion. The Democrats have insisted that nominees not be "outside the mainstream of American values", and I think a ruling like that is well within the mainstream. Even though most Americans aren't rabidly, categorically, and inflexibly anti-abortion, most of them do have a rather serious problem with the practice, and regulations like this would be something I'd bet a very clear majority would be in favor of. I mean, who could object to requiring that a baby's father be NOTIFIED before the baby's about to be killed? Did the law even require his consent?

But he [Luttig] also wrote in a 2000 case that a Supreme Court decision upholding a woman's constitutional right to an abortion was "super-stare decisis."

Right, and as I found out, he also justified it using that hideous phrase, "a woman's right to choose".

Pre-acting to something like this seems like peeing into the wind to me.

Plus, it gives the lefties all the ammunition they need to 'preact', too, making the whole "echo chamber" of nonsense even louder.

The difference between Luttig and Alito is the difference between them voting with Scalia and Thomas on precedent cases or voting with the liberal bloc.

I prefer someone more like thomas then scalia.

Scalia believes in stare decisis while, according to Scalia (Thomas has never denied nor confirmed this part) Thomas does not believe in the concept of stare decisis.

My honest assessment is that Taft, Voinovich and DeWine are radioactive to conservatives in Ohio. Ohio would be in real trouble, if not for Blackwell. Because of Blackwell turnout DeWine MIGHT turn out enough votes to win re-election, but it isn't given. Conservatives want an alternative. It would be a tough fight, but if you get alternative media working a grassroots momentum McEwen could toss DeWine out in a primary. The hostility to that filibuster deal they made is still very raw and will remain so, enough to make him vulnerbale to challenge.

Alito ruled that the feds could not regulate the posssession of machine guns, allegedly.

In that case, I favor Alito. He apparently can read the plain text of the Constitution.
