Dubya has made so many hints that he's going to pick Al Gonzales that he'll have some 'splainin' to do if he picks Al's successor as White House counsel instead.

Bush will have plenty of explaining either way; I have no use for Gonzalez, and Miers seems a non-entity with no record and no specific qualifications that would distinguish her from thousands of others.

In a word, Yes. A conservative who graduated from any of the top tier law schools. We're talking about pure horsepower here. Other than affirmative action admits, there is really a difference in how bright the students are at the various tiers of law schools, and a big difference in the quality of instruction and the orientation of the instruction. Once you get past the second tier, law schools become less intellectually rigorous and more "trade school" like. It's as much what the students demand as it is anything else.

I can accept that a brilliant legal mind may emerge from a lesser school. Family values, youthful priorities, or economics may discourage someone from initially aiming for the top teir; but, I see no evidence of brilliant mind. Popularity, and personal loyalty are irrelevant for an AJ; if they cannot argue their point of view, their held opinions are worthless.

I don't know about the "pro-business" part, but I want a court that will follow the constitution. I would like to see them out of the moral issues entirely.

I still say, nominate Hillary. Have the hearings, get some Repubs with gonads to ask questions that would make her squirm in her chair. Drag it out for weeks, call her back two or three times. Keep her busy. Ask about the finger prints on the law firm billing records. Ask about the travel office scandal. Ask about the FBI guy that wrote the book that had her in a dark room with another woman in a compromising situation. Just to give her a chance to clarify the record of course.

Then vote her down in committee. Damn what fun!
