Major Victory For Firearms Owners And Freedom In Louisiana

Friday, September 23, 2005

(Fairfax, VA) -- The United States District Court for the Eastern District in Louisiana today sided with the National Rifle Association (NRA) and issued a restraining order to bar further gun confiscations from peaceable and law-abiding victims of Hurricane Katrina in New Orleans.

“This is a significant victory for freedom and for the victims of Hurricane Katrina.  The court’s ruling is instant relief for the victims who now have an effective means of defending themselves from the robbers and rapists that seek to further exploit the remnants of their shattered lives,” said NRA Executive Vice President Wayne LaPierre.

Joining LaPierre in hailing the U.S. District Court decision was NRA chief lobbyist Chris W. Cox. “This is an important victory.  But the battle is not over.  The NRA will remedy state emergency statutes in all 50 states, if needed, to ensure that this injustice does not happen again."

The controversy erupted when The New York Times reported, the New Orleans superintendent of police directed that no civilians in New Orleans will be allowed to have guns and that “only law enforcement are allowed to have weapons.”  ABC News quoted New Orleans’ deputy police chief, saying, “No one will be able to be armed. We are going to take all the weapons.”

The NRA also pledged that it will continue its work to ensure that every single firearm arbitrarily and unlawfully seized under this directive is returned to the rightful law-abiding owner.

Established in 1871, the National Rifle Association is America’s oldest civil rights and sportsmen's group.  Four million members strong, NRA continues its mission to uphold Second Amendment rights and to advocate enforcement of existing laws against violent offenders to reduce crime.  The Association remains the nation's leader in firearm education and training for law-abiding gun owners, law enforcement and the armed services.

Why are the instigators of this outrage not sued out of their socks for violating the civil rights of those whose property was confiscated???

Dang! The NRA finally DID something!!

Unbelievably outrageous.

All I know is that, despite the fact that I live in Connecticut, they took from me a matched pair of consecutively numbered Colt SAA's, a H&K .40 S&W, half a dozen Glocks in various calibers, a set of Parker shotguns, one 12 ga and one 20 ga., an original Winchester 73, a pre 1964 Remington model 7, a really nice Benelli shotgun I've had my eye on, I mean I've owned for years. Let's see, there were so many others......

Hey EFKAB,
I think the bashers are going to have to just(What)
Victory always is a ncie thing to celebrate against the commie left gun grabbers.

The Police (commish or sup) needs to be fired for even thinking of such a stupid ass backwards policy to disarm the innocent law abiding citizens of NOLA.

He must have been promoted fast, for kissing Sarah Brady's (ass) have (no) gun will travel philosophy.

When guns are outlawed only the outlaws will have guns,

I reckon...I just remember the story saying that the police gave them no receipt, no nothing. They just took their guns and left.

We'll see if the responsible individuals are sued or just the government.

But it might not be safe to loot now!

Hey, careful what you say--it might not be safe to "touch things" now.

The confiscation was never authorized by due process so in my mind, the perp is the sheriff, acting on his own, and he should be made to pay (out the nose)!

Is it any coincidence that a post about Michael Schiavo speaking in public is directly beneath this thread? Or is it just me...

Nice to see our civil rights don't have to be sacrificied under these circumstances. It's also just common sense.

"We're going to take all the weapons." Yeah, the NO Police Department has been a paragon of virtue and a model of respect for the Constitution and for the Rule of Law in general. Right. To wit:

"The New Orleans Police Department has been rocked by successive scandals during the past several years: an officer was convicted in April 1996 of hiring a hit man to kill a woman who had lodged a brutality complaint against him and another officer was convicted in September 1995 for robbing a Vietnamese restaurant and shooting, execution style, a brother and sister who worked there, as well as an off-duty officer from her precinct working as security at the restaurant. In addition, at least fifty of the 1,400-member force have been arrested for felonies including homicide, rape, and robberies since 1993. As astutely noted by police abuse expert Prof. James Fyfe, some cities' police departments have reputations for being brutal, like Los Angeles, or corrupt, like New York, and still others are considered incompetent. New Orleans has accomplished the rare feat of leading nationally in all categories."

Seeing that the Courts have previously declared that police departments are not the protect and serve departments too many think they are, hopefully this will serve as showing that we individuals have the right to own the means to protect ourselves in times of norm and disaster.

Therefore this could put a halt to all gun control.

One more thing, before we get drunk on the fumes of success, let's see if this isn't going to be appealed by the new Attorney General, Gonzalez or whatever his name is.
