Unless the Senate decides to cut its recess short,
Part 6 of Senate Rule XXXI provides that all nominations active before August 1 will be returned to the President on September 5.
The operative language is, "if the Senate shall adjourn or take a recess for more than thirty days, all nominations pending and not finally acted upon at the time of taking such adjournment or recess shall be returned by the Secretary to the President, and shall not again be considered unless they shall again be made to the Senate by the President."

President Bush had a twinkle in his eye and was quite feisty today at the news conference. I think he will nominate somebody conservative, but not conservative enough for a lot of people here. Lindsay Graham was on Fox today and said Bush has gotten the green light from some very liberal members of congress. Because of this, I'm not feeling the 'warm and fuzzies' about who he'll nominate. I certainly hope I'm wrong.
