President Bush will make remarks on the death of Terri Schindler (Schiavo) at 11:40 am EST.

EXECUTIVE ORDER NUMBER 03-201

         WHEREAS, on October 21, 2003, the Florida Legislature passed House Bill 35-E (to be published as Public Law 03-418), signed this date by me, authorizing the Governor to issue a one-time stay in certain cases where, as of October 15, 2003, the action of withholding or withdrawing nutrition or hydration from a patient in a permanent vegetative state has already occurred and there is no written advance directive and a family member has challenged the withholding or withdrawing of nutrition and hydration; and

         WHEREAS, under House Bill 35-E a person may not be held civilly liable and is not subject to regulatory or disciplinary sanctions for taking any action to comply with a stay issued by the Governor pursuant to House Bill 35-E; and

         WHEREAS, in the case of Theresa Marie Schindler Schiavo, Robert Schindler and Mary Schindler, the parents of Theresa Marie Schindler Schiavo, have requested that the Governor enter a stay prohibiting further withholding or withdrawing of nutrition or hydration; and

         WHEREAS, a court has found that Theresa Schiavo is in a persistent vegetative state as of October 15, 2003; and

         WHEREAS, Theresa Schiavo had no written advance directive as of October 15, 2003; and

         WHEREAS, nutrition and hydration have been withdrawn from Theresa Schiavo, and continues to be withheld as of October 15, 2003; and

         WHEREAS, the Schindlers have challenged the withdrawal and withholding of nutrition and hydration as of October 15, 2003; and

         WHEREAS, an immediate and urgent need has arisen to address the removal of nutrition or hydration, because death due to lack of nutrition and hydration is imminent;

         NOW THEREFORE, I, JEB BUSH, Governor of the State of Florida, by the powers vested in me by the Constitution and laws of the State of Florida, specifically House Bill 35-E, do hereby promulgate the following Executive Order, effective immediately:

         Section 1          A.  Effective immediately, continued withholding of nutrition and hydration from Theresa Schiavo is hereby stayed.

         B.  Effective immediately, all medical facilities and personnel providing medical care for Theresa Schiavo, and all those acting in concert or participation with them, are hereby directed to immediately provide nutrition and hydration to Theresa Schiavo by means of a gastronomy tube, or by any other method determined appropriate in the reasonable judgment of a licensed physician.

         C.  While this order is effective, no person shall interfere with the stay entered pursuant to this order.

         D.  This order shall be binding on all persons having notice of its provisions.

         E.  This order shall be effective until such time as the Governor revokes it.

         F.  The Florida Department of Law Enforcement shall serve a copy of this Executive Order upon the medical facility currently providing care for Theresa Schiavo.

         IN TESTIMONY WHEREOF, I have hereunto set my hand and have caused the Great Seal of the State of Florida to be affixed this 21st day of October, 2003.

I agree with you too. I can't believe how many nutty people are coming out amongst us to blame the president for this when this is clearly the result have poor lawyering and/or abuse of judicial power.

The Greer decision was a travesty.

Don't you love how it is a collective "we" that did this. Like being in a hospital and having a nurse say "we" have to get our shot now.

Just useless emotion. They can't think straight so they just spout out whatever broken thoughts pass through their impaired brains.

The ones that get me are those who say we're all Nazis and the U.S. is as evil as Nazi Germany. They obviously have no clue as to what the Nazis really were. Instead, just like the left, they throw out the "You are a Nazi" crap whenever someone doesn't agree with them.

It would have been nice if Pres. Bush would have went down to the Hospice while he was in Florida and simply prayed with them. There is no law against that and also if he would have talked to them directly as a man and father....and told them directly his situation..

Railroads were notoriously difficult targets to hit in WW2. They took a disproportionate number of aircraft to knock out a railroad.

And most German railways were fully functional a day or two later, sometimes as quickly as the next morning.

Plus, in spite of what we know now, few truly believed what was happening in Auschwitz. That is why the world was so horrified upon learning the facts after liberation.

Even more, Auschwitz was in the Russian sector of war. Under no circumstances would Stalin had allowed such an action. I'm doubtful that any Allied aircraft would have had the range to hit Auschwitz, anyway.

In response to the killing of Terry Shiavo, I went out and bought Mark Levin's book, Men in Black. I suggest that everyone do the same and prepare themselves for the coming fight over the judiciary appointments. The best thing that we can do for Terry Shiavo is to give her life new meaning in our fight to reform the courts.

absolutely. he's looking and must look at the bigger fish to fry which is the abusive courts. the greer decision was wrong. how can you possibly not find a conflict between the husband and what he said his wife's wishes were.

If you error why not error in life by giving the family, who wishes to bare the burden of taking care of her, in that situation.

She had no clear living will.

I personally wish that President Bush wouldn't say anything about Terri, at least not today and not so soon after her death. It has the appearance of being Clintonesqe like, all for the sake of political gain after someone's death.

IF he understood the Florida State Constitution IF he understood the division of powers IF he understood the limits of judicial powers IF he understood the supremacy of the executive powers the governor holds IF he understood judicial tyranny.

Or if just read the chapter of the Florida Code that the Judges used to allow this atrocity. The 2004 Florida Statutes

Title XLIV
CIVIL RIGHTS Chapter 765
HEALTH CARE ADVANCE DIRECTIVES

765.309 Mercy killing or euthanasia not authorized; suicide distinguished.--

(1) Nothing in this chapter shall be construed to condone, authorize, or approve mercy killing or euthanasia, or to permit any affirmative or deliberate act or omission to end life other than to permit the natural process of dying.
.

Surely withholding water or other fluids is a "deliberate ... omission to end life". It's certainly not natural to starve to death, when food is available, nor to die of dehydration when water is at hand.
