Judge George Greer ruled that the State of Florida has no right to take custody of Terri Schiavo, which ruling came hours after an appeal by Terri's parents to re-insert the feeding tube was refused by the U.S. Supreme Court.
Meanwhile, another hearing was scheduled tonight before US District Judge James D. Whittemore .. the same judge who previously heard and denied the request subsequent to the 'de novo' intention of the law past last weekend by the Congress and signed by President Bush, in an effort to confirm that no stone was left unturned before Terri would endure legally sanctioned dehydration until death.
Was the 11th before a 3 judge panel?

With this cover note, please distribute to the world. Understand, there is little here, and THAT is the crime. It's NOT about Michael Schiavo. This is about the DIRECT INVOLVEMENT of Pinellas Pasco State Attorney Bernie McCabe in making certain NO INVESTIGATIONS would occur; this is about his using his official office and influence to block the Schindler Family and ultimately their daughter Terri from accessing the police services of the Pinellas County Sheriff's office, St. Petersburg City Police, Pinellas Park Police, the Florida Department of Law Enforcement, Florida Attorney General Charlie Crist (whose home county and political associations are in Pinellas County Florida) -- AND -- that is important to understand given the COMMON KNOWLEDGE that McCabe has a long political association with George W. Greer who, some allege, is an office he is not legally qualified to hold; I don't know if that is true. This is a very complex web of personal, professional, political associations -- Greer, McCabe, Rice, Michael Schiavo shown favor of a job (nothing wrong with that) in the Sheriffs jail by Rice, hospice officials and board members and George Felos with influence over that organization being chairman of the board up to the moment Terri was warehoused in a darkened room with not even the joy of a toothbrush -- among others. A person directly involved in this just said to me, "McCabe has a HAMMER on this." And, a lawyer in California with lawyers on the ground in Florida said this morning, "...ANY LAWYER WHO APPROACHES ANY COURT WITH ANY ISSUE IS GOING TO BE HIT WITH HEAVY SANCTIONS." The judiciary wants this murder really bad. BUT -- AT THIS PRECISE MOMENT, focus attention on Greer-McCabe. There are serious people interested in developing a case for capital murder if Terri dies. This family, THIS WOMAN has been denied due process, PERIOD. It is a BLOT on America's CRIMINAL and CIVIL injustice system, a system not of law, but men who so despise law that they would murder this helpless aware of self disabled woman.

Terri's former guardian also teaches at USF.
Dr. Jay Wolfson is director of the Florida Health Information Center at the University of South Florida in Tampa.
He is also a lawyer.
The University of South Florida is intimately connected to Hospice and Hospice of the Florida Suncoast (the corporate owner of the hospice where Terri was being dehydrated and starved, and where she is once again interned).
The USF website gives information on continuing professional education to be held at the University of South Florida's Center for Hospice, Palliative Care and End-of-Life Studies.
The University of South Florida, Dr. Jay Wolfson's employer, has a partnership with, among other hospice organizations, the Hospice of the Florida Suncoast.
How convenient! He's been all over the TV defending his prognosis.

I think those of us who care and who have been here fighting are tired, discouraged, frazzled and a little quick on the trigger...myself included.. I'm trying to work on that in myself.. not always successful.. I think it's important to weed the small disagreements from the intruders and disruptors..
The first time I heard that all this was happening there and heard Greer is the judge, my heart sank.

The parents, who believe their daughter could improve, took their case back to the 11th U.S. Circuit Court of Appeals in Atlanta — the same court that has ruled against them twice this week. In Michael Schiavo’s response, his attorneys argued that the Schindlers have abandoned all pretense of the law and are simply making “a pure emotional appeal.”
Another legal maneuver included a late afternoon filing asking Pinellas Circuit Judge George Greer to order the reinsertion of the tube, claiming Terri Schiavo tried to say “I want to live” the day her tube was removed.

The more I dig, the sicker I get. I really feel like throwing up. Part of me wants to stop looking and pretend it doesn't affect me. But I guess that would be from fear and we know who puts that there. This is all related and it's horrifying!

Gee, Vel, I didn't realize that Tom Harkin (D--Iowa) was a Christian extremist. He supported the bill in Congress.
The Schindlers have to beg to get into Terri's room. Sometimes they are kept out for hours. No artist would be allowed in.
This is the frustrating part for me.
Were this a leftist effort on appeal, the judges would have a tendance to find "spirit" in laws that were never in existence. Conservatives would then say they court is making up law.
Conservatives pass a specific and so the judges say the "spirit" of law is irrelevent and go by the LETTER of procedure.
I have not stated it eloquently but it does seem the courts have now established a two track standard of justice. Once track of analysis if the petitioning party is on the right and a seperate track of analysis if the petitioning party is on the left.
