Michigan bill would ban medical decisions if adultery is involved

A Michigan lawmaker is working on legislation that would prohibit a spouse having an affair from denying food, fluids or medical treatment to a wife or husband who cannot make such decisions.

Rep. Joel Sheltrown on Tuesday said he wants to avoid a situation similar to Terri Schiavo's.

Sheltrown, a Democrat from West Branch, said Michigan should strengthen its protections before a similar situation happens here.

"While people, in happier times, may trust their spouses to make future medical decisions for them, situations change," Sheltrown said in a statement. "In a situation where an incapacitated patient lives at the mercy of an adulterous spouse, it is in the patient's interest to make a presumption in favor of life."

Michigan law already prohibits the denial of life-sustaining treatment, such as food and water, unless the patient has expressed that such action be taken, said Sheltrown, who expects to introduce the bill in about three weeks.

Wouldn't it be simpler to say that unwritten evidence will not be accepted as the basis to withdraw life support?

sounds a h*ll of a lot better than what's going on here...

but anyone who now doesn't get their stuff together - on paper and notarized - is leaving their relatives in a precarious position.

Myself, I'm going to rewrite mine to include a time table to allow me time to "come back" - which many have, against all 'expert" pronouncements - and that there damn well be a plug to pull - i.e., REALLY on "life support" - not just needing food and water - again, for a given period of time.

I sure don't want my kids to have to make the decisions, and disagree over degrees, as it were - and my "wishes paper" will be with my kids, NOT a lawyer or doctor, who then take any decisions out of the families hands and interpret them however they wish...

Forced Feeding is considered extraordinary medical treatment that can be refused according to Fl. and U.S. Law. The language of such law is even written into the Fl. Constitution.

15 years of forced feeding of a non-cognitive person is inhumane and shows a sick selfish self absorption on the Schindlers parts. They have testified that they would continue to force feed her indefinitely even if she'd told them she would refuse such treatment.

Therefore we know they represent their own wishes...nor Terris.

I agree with you that Congress has let this get out of control. There is not a doubt in the world about that. It's been going on for years and years.

The Democrats couldn't get their legislation passed through Congress and the people's desires, so they turned to the radicalized members of the judicial branch to do it.

And Congress is reaping what they sow these days. Or is it sowing what you reap? I always get confused on that :-)

Did you hear the statement by the Schindler's? That Terri will "burn in hell" if she dies this way.

Are we to assume all those who for whatever reason are incapable of writing up a living will, want to die or don't care?

I'd say there are probably many. Aside from that, I guess your saying everyone in America better have a living will or we can assume they want to die if in a incapacitated state.

And you are saying the Schindlers did not have adequate legal representation? Now, whose fault is that? Certainly not anyone's fault but their own. Are they or are they not able to hire any attorney they wish?

ahh, but the point is = TERRI was never allowed an attorney to represent her.

And that made all the difference

But the Schindlers were allowed to have an attorney to represent them, and Terri.

And Terri has had 4 guardian ad litems. All of them have said she is PVS.

You seem unaware that Florida law considers feeding tubes to be part of what they call life saving equipment.

you seem to be ignoring the other part of my answer - that there are affidavits that Terri did not need the feeding tube - but that MS refused to let her be fed by mouth - and has even had a judge order that no one try or test this again

so I guess this would mean that if you want "legal" sanction for offing your spouse, just forbid them to be fed by mouth, making a 'tube' necessary and THEN, you can legally kill them?

WEll, that clears that up and makes it simple

I've seen it happen with Catholics out the wazoo. They will lie, cheat, steal, curse, commit adultry, be drunks and be involved in every other sin conceivable sin, but they can't divorce because it's against their religion.

Have you read the facts of the case? Terri cannot medically take food and water if she had tried she might choke to death.

reports and affidavits by nurses who took care of her for an extended time and doctors who have examined her refute this. If she couldn't swallow on her own - as she does all day long - she would choke on her saliva - and would need a device to give her the swallowing ability - or have to be aspirated several times a day - which she isn't

Allowing this judge to make a life and death decision was never what the Constitution intended or allowed.

Don't put words in my mouth or we won't communicate again.

Does it not interest you at all that in 2002 the Schindlers chose two doctors to represent them in court and they were of course permitted to call witnesses.

Yet not one of these nurses testified under oath in court. Doesn't that make you wonder why the parents, who visit Terri frequently and surely talk to these nurses, didn't call them to tell the world that Terri can swallow?

The Schindlers lawyers could only represent THEIR wishes - not Terri. (If you don't get this, try hiring a lawyer to represent someone in your family who is married to someone else...)

the so called guardians - I've read reports where one was a relative of the Judge - appointed by the judge - who also appointed the others - who were not lawyers or doctors? (conflict?)
