Michigan bill would ban medical decisions if adultery is involved

A Michigan lawmaker is working on legislation that would prohibit a spouse having an affair from denying food, fluids or medical treatment to a wife or husband who cannot make such decisions.

Rep. Joel Sheltrown on Tuesday said he wants to avoid a situation similar to Terri Schiavo's.

Sheltrown, a Democrat from West Branch, said Michigan should strengthen its protections before a similar situation happens here.

"While people, in happier times, may trust their spouses to make future medical decisions for them, situations change," Sheltrown said in a statement. "In a situation where an incapacitated patient lives at the mercy of an adulterous spouse, it is in the patient's interest to make a presumption in favor of life."

Michigan law already prohibits the denial of life-sustaining treatment, such as food and water, unless the patient has expressed that such action be taken, said Sheltrown, who expects to introduce the bill in about three weeks.

Why stop at adultery? How about having an email girlfriend, or cheating on one's taxes? How about not going to church enough, or generally just being a punk?

Endless stipulations....and the beat goes on.

I particulary like the "email girlfiend."

Cyber girlfiend is good, too.

Yeah. Say a woman is hospitalized and all messed up, and her husband has to make the call (a call that might be 'she lives,' you know).

Wait a second! Some idiot comes in and points out that the loving hubby had sex with his secretary at the Christmas party 4 months ago! FOUL!

So does that qualify as adultery? Now he has no say in the matter? So who gets the say then? Parents? What if they aren't any. Siblings? Then who?

People should just get living wills - while not perfect, they do make the person's intent crystal clear.

It is possible that, for example, a married woman can be getting sex from that hunky UPS guy once a month every time he delivers one of those monthly baskets of fruit (that her hubby got her!), and still dearly love her husband and make a fair and wise call on his life.

Then again, maybe not.

Sheesh!

Hopefully, more states will consider a bill like this. This could have prevented this whole situation with Terri Schiavo.

Yes. Let's also consider a bill that requires that nanny staters look in the spouse's trash.

If they find more than six empty beer bottles, the offending spouse is immediately disqualified from any standing in the case.

Do you realize that, had the Schindlers agreed to remove the feeding tube eight years ago, it would have been removed?

This is not about saving Terri Schiavo. It's about the Schindler's versus their son-in-law.

The Florida law allows this to happen. Direct your ire toward the Florida legislature. It's up to them to change the law so that judges can't make this decision.

Did you hear the statement by the Schindler's? That Terri will "burn in hell" if she dies this way.

These people are nuts. Absolutely, friggin' nuts!!

why that would be the Federal Government getting involved in a state issue, I thought that was bad.

I have no intention of testing the constitutionality of this legislation. But surely someone else will.

And I think it's so interesting that now when family members have an agenda and get into arguments about this matter, we can petition Congress AND the president.

Who knew they had so much time on their hands?

Of course, we're going to need a LOT more judges. But hey, no problem. We all love lawyers so much and all.

I could live with this law. Makes perfect sense to me.

I still don't believe Mr. Schiavo has done a fraction of the terrible things attributed to him by the Save Terri Coalition however.

With as long as this has been litigated and as many judges reviewing it, it would be impossible for a judge not to sustain an objection thrown by the opposing lawyers.

This is insane. How are they going to define an affair? A moment of weakness? Kissing somebody of the opposite sex? Platonic relationships? Does sex have to be involved?

And I continue to be surprised how many people who consider themselves conservative happily support the expansion of government and additional laws as long as they perceive any temporary gain.

All of this on going medical care is going to cost someone right? So let's up the cost of that, oh and Insurance premiums too.
