The Terri Schindler Schiavo Daily Threads are created month to month as we watch local and national news regarding Terri and her family.

Since Terri's supporters are in every time zone, you may see something FIRST. Please share news with us that you don't see here already. Now, why would you want to do that? Terri's Daily Thread for September/October of 2004 was viewed over 15,000 times. Terri's November Daily Thread was viewed over 6,000 times. December's thread is over 3,000 views.

More and more good folks are finding out about Terri and that judicial tyranny would take her life, but for lots and lots of prayer and non-stop lobbying of relatives, friends, clergy, our leaders, the media, a passerby, a cashier - ANYONE who you feel comfortable chatting with.

Folks always want to know how can this be in America or on earth for that matter? Unfortunately, this is really happening to an innocent woman who just celebrated her 41st birthday. She's not the only one but she's the one with devoted parents and siblings who knows what's in Terri's heart. Terri has a strong will to live. That's apparent. It's been 14 years.

Besides, feeding tubes have been around practically since the Civil War. They are not high tech devices. Terri is "not hooked up to machines". Her feeding tube is the diameter of a piece of spaghetti.

Talkin' about Terri is the best way to lobby for her. It is a salespitch to save her life and subsequently, many lives. If you've never sold anything in your life, START NOW. START WITH TERRI.

This man in the image, death attorney George Felos, is desperate to end Terri's life. Yesterday, he told a news reporter that Terri's brain is full of water; that Terri has no consciousness; that Terri is a houseplant. Mr. Felos is angry that Terri is still alive.

Attorney Ken Connor tells reporters that since the U.S. Supreme Court is declining to take the case, the governor's participation in the Terri Schiavo (SHY'-voh) case has ended. He says it's regrettable that the governor never got to have his day in court.

It looks like you are right. Both Gov. Bush and President Bush could use the bully pulpit to help this woman. I've never heard President Bush utter one word in support of Terri and there is no way he doesn't know about this case.

Maybe a boycott of the Republican Party fund raising would help, especially the Republican party in Florida who helped get Judge Greer re-elected.

Supreme Court Won't Hear Schiavo Case

In a decision issued without comment, the U.S. Supreme Court has refused to hear an appeal from Florida Governor Jeb Bush regarding the controversial Schiavo Act.



This law delegated emergency powers to Governor Bush to prevent Michael Schiavo from ordering the removal of his wife's gastric feeding tube. The law has been ruled unconstitutional by the Florida Supreme Court.



In other recent motions in this case, Terri Schiavo's parents have filed an amended petition with Florida's Pinellas Circuit Court asking that Mr. Schiavo be removed from guardianship due to conflicts of interest. A previous petition to this effect was denied.



They have laso filed a motion asking the circuit court to void its previous order in the case. The 2000 order allows Mr. Schiavo to have doctors remove the gastric tube. The motion claims that Mrs. Schiavo was denied her right to due process of law because she never had her own attorney.



Both new motions follow a denial by Florida's Second District Court of Appeals of a motion for a new trial, also filed by Terri Schiavo's parents. The court issued the denial without a written opinion on December 30.



Stays against removing Mrs. Schiavo's gastric tube have been in place during the appeals process. For more information about this case, see below.



Background

Florida woman Terri Schiavo has existed in a persistent vegetative state since her heart stopped suddenly in 1990. A bitter court battle has ensued in regard to her treatment.



Husband and legal guardian Michael Schiavo wishes to remove the gastric tube that has been providing Mrs. Schiavo nutrition and hydration, claiming it was her expressed wish not to live in such a state or condition. He is opposed by her parents, Bob and Mary Schindler, who do not believe that their daughter ever expressed such a preference.



After extensive testimony various courts, including the Second District Court of Appeals, agreed with Michael Schiavo's position. In October 2003 a court order allowed Mr. Schiavo to have his wife's gastric tube removed. Six days later it was reinserted at the direction of Florida Governor Jeb Bush, under emergency powers granted by the state legislature.



Backed by the ACLU, Michael Schiavo challenged the constitutionality of the Schiavo Act, the legislation which allowed the executive order. The Fourth Circuit Court of Appeals lifted the legislation on the grounds that it violated Mrs. Schiavo's right to privacy, but that ruling was stayed by the Second District Court.



The law was ruled unconstitutional by the Pinellas Circuit Court on May 6. The ruling states that the law is unconstitutional for two reasons: it violates Terri Schiavo's right to privacy, and it delegates legislative power to the governor.



The governor's office immediately filed an appeal with the Second District Court, which was expedited to the state Supreme Court. The Florida Supreme Court issued its unanimous ruling striking down the law in September, concurring with the lower court that the law violated the doctrine of separation of powers. The governor requested a rehearing by the Florida Supreme Court, which was rejected without comment.

To KILL this woman who has FOUGHT to LIVE in INCREDIBLY DEPRIVED CONDITIONS FOR OVER THIRTEEN YEARS and who is still ALERT and INTERACTIVE IS MURDER.

Michael-if you are reading this and having a good time enjoying the alarm, you need to know , you and Jody, (the name of your concubine?) that this is not over.

I think it was DRUDGE OVERLOAD BUT THAT'S A GOOD THING FOR TERRI'S FIGHT. Drudge is new to this fight. He was criticizing the US Supremes last night for losing touch with reality, and I can see his point 100%.

I think the site was experiencing high traffic. c-span 2 is on right now. The pro-life republicans are expressing their dismay with judicial activism. THAT INCLUDES THE JUDICIAL HOMOCIDE OF TERRI SCHINDLER SCHIAVO if the tyrannical judges honor felos' wishes. These are not Terri's wishes. They are the euthanazi's wishes.

President Bush said he supported his brother re: Terri's Law but that's a way to back out because Terri's Law no long exists. They parse carefully so they can get out of a jam. Terri shouldn't have to pay with her life because of politics.

Despite the widely believed claims of her husband, Terri Schiavo is purposefully interactive, curious and expressive with her parents, according to a surprised lawyer who visited for the first time the brain-damaged Florida woman embroiled in a euthanasia dispute.

After a 45-minute visit Christmas Eve, attorney Barbara Weller concluded Schiavo was so alert that she "should have been gathered around the Christmas dinner table enjoying the holiday with her family."

Weller, along with attorney David Gibbs, took over the lead counsel role in September for Terri's parents, Robert and Mary Schindler, who are in a protracted legal battle with her husband, Michael Schiavo, to keep their daughter alive.

Gibbs also was present during the Dec. 24 visit.

Not knowing what to expect, Weller said in a narrative posted on the family website she "prepared for the possibility that the Schindlers love their daughter and sister so much that they might imagine behaviors by Terri that aren't actually evident to others."

But she was "very surprised" to find that, "From the moment we entered the room, my impression was that Terri was very purposeful and interactive and she seemed very curious about the presence of obvious strangers in her room."

Noting that Terri was not in bed but dressed and groomed and sitting in a chair without any tubes attached, Weller wrote:

The thing that surprised me the most about Terri as I took my turn to greet her by the side of her chair was how beautiful she is. I would have expected to see someone with a sallow and gray complexion and a sick looking countenance. Instead, I saw a very pretty woman with a peaches and cream complexion and a lovely smile, which she even politely extended to me as I introduced myself to her. I was amazed that someone who had not been outside for so many years and who received such minimal health care could look so beautiful. She appeared to have an inner light radiating from her face. I was truly taken aback by her beauty, particularly under the adverse circumstances in which she has found herself for so many years.

As WorldNetDaily has reported, Terri collapsed in 1990 in the couple's St. Petersburg apartment. For reasons never satisfactorily explained, oxygen to her brain was cut off for several minutes, leaving her unable to talk and dependent on a feeding tube for food and hydration at the age of 26.

In a 2000 trial, Michael Schiavo persuaded Florida probate Judge George Greer that Terri is in a "persistent vegetative state," which in the absence of a written directive, allowed Michael Schiavo to request removal of her feeding tube.

In November, however, Greer ruled the tube cannot be removed until the Schindlers have exhausted all avenues in their quest for a new trial to determine whether or not their daughter would want to be starved to death.

Michael Schiavo insists he simply is carrying out his wife's wishes, but Terri's parents contend Terri is alert, has a strong will to live and could be significantly rehabilitated with aggressive therapy. More than a dozen physicians, therapists and speech pathologists have stepped forward to state agreement with the Schindlers.

The parents also assert Michael Schiavo's interests are conflicted since he has lived with another woman for at least nine years with whom he has had two children.

Weller said that during the visit Dec. 24, "Terri's parents, sister and niece went immediately to greet Terri when we entered the room and stood in turn directly beside her head, stroking her face, kissing her and talking quietly with her.

"When she heard their voices, and particularly her mother's voice, Terri instantly turned her head towards them and smiled," Weller continued. "Terri established eye contact with her family, particularly with her mother, who spent the most time with her during our visit."

Weller said the "whole experience was rather moving."

"Terri definitely has a personality," she said. "Her whole demeanor definitely changes when her mother speaks with her. She lights up and appears to be delighted at the interaction. She has an entirely different reaction to her father who jokes with her and has several standing jokes that he uses when he enters and exits her presence."

Weller said she "never imagined Terri would be so active, curious, and purposeful."

"She watched people intently, obviously was attempting to communicate with each one in various ways and with various facial expressions and sounds," she said. "She was definitely not in a coma, not even close. This visit certainly shed more light for me on why the Schindlers are fighting so hard to protect her, to get her medical care and rehabilitative assistance, and to spend all they have to protect her life."

A Message from the Foundation:

The Schindlers are obviously disappointed that the U.S. Supreme Court did not decide to hear the appeal in Gov. Bush's case. However, they are profoundly grateful to Gov. Bush and his staff and legal team for their diligent efforts on behalf of their daughter, Terri Schiavo. This decision by the U.S. Supreme Court does not in any way affect the Schindler's ongoing legal matters in the Florida state courts. There are still three important legal issues to considered in the Florida courts.

1) There is still a petition pending in the Second District Court of Appeals in Lakeland, FL regarding Terri's right to the free exercise of her religion, rights which the Schindler's attorneys believe have been violated.

2) On Friday, Jan. 28, in the Probate Court in Clearwater, FL, Judge Greer will hear the Schindler's motion to protect their daughter's due process rights. The Schindler's attorneys will argue that the 2000 Order authorizing Terri's death by starvation and dehydration is null and void because Terri's due process rights were not protected in the 2000 trial.

3) Finally, the Schindlers still have a pending Petition before Judge Greer to remove Michael as Terri's guardian and to replace him with Terri's brother and sister, Bobby Jr. and Suzanne. They believe that Michael's numerous conflicts of interest with his ward, Terri, disqualify him from continuing as her guardian.

JEB BUSH PRESS CONFERENCE TODAY at 1:30 pm. After the press conference, his staff didn't even know what he said. I told them I read on the internet that he was throwing in the towel but I hoped it wasn't true, etc. Protective custody requested.
