Mo, we have those ballots where you fill in an elliptical/oval shape with a pen, like on an exam.
If you look directly to the left of each name, you will faintly see the ovals, which would indicate a vote for the corresponding candidate.
There are no ovals filled on this ballot.
What there is, is a smudge-like pen mark nearest Christine Gregoire's name...so in King County, that means the voter "intended" to vote for Gregoire.
The standards are whatever Democrats want them to be, at the time they need them.
Being a resident of this state and county right now is a horrible feeling, I'll tell you. Democrats here are vile, arrogant, and power-hungry. And it's scary.
Well, well, well. I see this was on King5, hope it is not photoshopped. If so, it will hurt us. If this is true, Dino Rossi will have every bit of support he needs to contest the election. Unbelievable that all this can be "error." It is fraud.
There's a built in deniability there. If anyone is investigated, they can say under oath that they did not tamper with the ballot.
And it gets the canvasser off the hook too. They can say they honestly thought it was an intent to vote for Gregoire.
I'd think that proving collusion would be pretty hard. It's downright Clintonian.

Wrong-O! The 'law" provides for contests of election results and other measures. We are NOT going to just slink off and say oh well. That was another time, another place, and different Republicans.

There's the Equal Protection argument for the Federal courts.
Whether your signature was mistakenly challenged or whether you're a member of the military who didn't receive your ballot on time, your vote should count.

I wrote that before I saw the thread with Rossi's statement and GOP's new strategy of giving them a taste of their medicine. Glad to see that we're finally growing spines!!!

Even if a voter's intention was clearly and unambiguously to vote for Gregoire, if the voter's intention was to do so in anything other than the legally authorized way, the vote is not valid.
In Rockford, IL there have been elections turned on the question of whether ballots should be accepted if the voter put a check mark in the box instead of an "X". The answer has consistently been that an "X" is a vote, but a check mark, circle, filled in square, or other such marking is not a vote. Not sure whether a script "x" would quality, but if I were a voter I wouldn't push it.
Yes, but they tightly control the Courts in WA. Why not a Federal case? Will we need to arrive to the Supreme Court? I really don't know, but we must fight!

The idea that "there's no fair way to determine intent" is incorrect. It is CLEAR that they intended NOT to vote for ANYONE in that race. I agree that the ballot should be thrown out.
Count me down as being in favor of that last option.
