We Want a Strong Leader on the Senate Judiciary Committee
The reelection of President George W. Bush and the increase of 4 Republican seats in the Senate offer Republicans an opportunity to have judicial nominees approved by the full Senate.
Self-proclaimed moderate Sen. Arlen Specter (R-PA) is in line to become chairman of the Senate Judiciary Committee. Specter helped kill President Reagan's nomination of Robert Bork to the Supreme Court and that of Jeff Sessions to a federal judgeship.
On November 3, Sen. Specter issued the following blunt warning to the president concerning judicial nominees.
"When you talk about judges who would change the right of a woman to choose, overturn Roe v. Wade, I think that is unlikely. The president is well aware of what happened, when a bunch of his nominees were sent up, with the filibuster. [A]nd I would expect the president to be mindful of the considerations which I am mentioning."
This statement by Sen. Specter indicates he would apply a pro-choice litmus test to the president's nominees and would likely not pass them out of committee if they did not meet that litmus test.
Republicans cannot lose this fight to a moderate Republican. Tell the members of the Senate Judiciary Committee that we demand strong leadership.
To Republican members of the Senate Judiciary Committee:
We consider approval of President Bush's judicial nominees to be one of the defining issues of our time. Strong conservative leadership will be of the utmost importance.
To that end we urge you not to elect Sen. Arlen Specter as chairman of the Senate Judiciary Committee.

Dear Senator Frist,
After a long and contentious fight to retain the White House and expand our majority in both houses of Congress, I am extremely dismayed by comments made by Senator Specter regarding the President's right to choose his own candidates for the nation's judiciary. After several years of stonewalling on the part of Democrats in the Senate Judiciary Committee, it is incredibly distressing to see a member of the Republican party attempting to block excellent and qualified judges from the bench because of their conservative ideology.
I am a partisan. I will continue to work for our party's success because I believe that we embody the principles that are best for the nation. But make no mistake, conservative members of the Republican party will not continue to support the GOP if a very small minority of our Senators refuse to give a fair hearing to judges who agree with the party platform.
The last election should be a wakeup call to party leadership. The single most important issue to voters was "moral values". The party did a masterful job of getting Evangelical and other Conservative voters to the polls - voters who stayed home in 2000 - largely because of the moral issues facing the nation. It would be disastrous for the party and country if these voters felt betrayed and did not return to the polls in 2006 and 2008.
Renegade judges have been legislating from the bench for decades and have recently accelerated a dangerous experiment in social engineering - whether by redefining marriage, tinkering with the Pledge of Allegiance, or ruling against late term abortion restrictions. The American people recognize this judicial tyranny for what it is, and we look to you and other members of the Senate to put a stop to it.
Senator Specter and Democrats in the Senate say that the President should not nominate candidates with a conservative ideology because they are "outside the mainstream". If that is the case, most of the country must be outside of the mainstream. The vast majority of Americans support some limits on abortion, and clearly Tuesday's results in the states voting on Marriage Amendment should prove that this country will not accept gay marriage as a government supported institution.
In light of all of this, I am writing to you to urge you to take action to remove Senator Specter from the Judiciary Committee. The idea that this man, who won a tough primary fight only with the help of the White House, could be the next Chair of the Judiciary Committee is truly frightening. Please take steps to ensure that he does not aid liberals in continuing to block the President's agenda.
I understand that this move could lead to Mr. Specter defecting to the other side. In reality Senator, he made that defection long ago. Please do what is right and help President Bush and the majority of the American people in seating solid judges, without forcing them to pass a liberal litmus test. As our majority leader, we are counting on you.

It would seek a ruling from the Senate parliamentarian that the filibuster of executive nominations is unconstitutional.
It is possible that the parliamentarian would advise the chairman to rule against the GOP. In that case, Republicans could force a vote overruling the chairman, ramming through the decision on a simple majority vote."

I called the Louisiana Right to Life office and they weren't even of this development with regards to Spectre's statement, which is frightening.
I applaud all the passion coming from FreeRepublic on this matter. Folks, pick up your pitchforks and join the movement. WE ARE NOT THE MINORITY ANYMORE and the results of this election has now overcome the forces of the Olympia Snowe's and Chaffee's of Senate.
The wind is at our backs......this is the time for change for the culture of LIFE!
I called every member of the Juduciary Committee, and Senator Frist and Rick Santorum. I suggested to Santorum's office if he gets on board with this, it would be a way for the good senator from PA to redeem himself after backing Specter.

Remeber Clinton, and gays in the military? I don't think abortion should be the first issue Conservatives push for. I think this mobilization to smear Spector on this issue and campaign for anti-abortion judges borders on hysteria.
I think many of you are unfairly blaming Spector for something that may have been media distortion and without looking at his past record.
Sure I dislike Spector, but mainly for economic reasons.
I also strongly support President Bush's decision that there shouldn't be a litmus test for appointing judges to the Supreme Court. Some on here seem to think there should be.
A litmus test means they will be good judges with integrity, professionalism and fairness. To have a litmus test is to say 'I will promote someone who will undo Roe vs. Wade' is just like Kerry saying he would appoint someone who will keep the ruling in place. They are both equally disturbing and either statement should bring strong condemnation by those who truly understand the law and the Constitution.
If you are already ruling on the matter before the case is even brought then what is the need for judges? Who interprets the law the president or the judiciary? I know many people on here want the president to specifically select a judge who would overturn Roe vs. Wade. I strongly disagree with this whole line of thinking. In fact, its dangerous because it interferes with the constitution of the United States.
The judiciary should be independent of the executive branch and should be selected based on their professionalism, integrity and knowledge of the law.
