The healing process....

. . . should consist of a little hempen therapy for the perp-- the kind that wraps around his neck, not the kind that is smoked.

As for the judges who release unprocessed sewage of this nature into society-- they should be treated just like a toxic chemical waste dumper-- fined, run out of the business and jailed. This is professional negligence far worse than a doctor who gets drunk and botches an operation. I wouldn't look for Johnny Edwards trail lawyer buddies to take to suing negligent judges.

"The Judge and that piece of crap former public defender, C.J. Ceiza (D) should be forced to give the eulogy."

...and dig the hole at the cemetery.

Even though the raunchiness of the Half time show and Janet's peep show does not help morality in America this scum-bag is a troll that was looking for an innocent little girl, like a lion hunting for it's prey. There sick and there are more out and about now than ever. I just know when I was a kid we knew all our neighbors and everyone watched out for each other, who in the heck cares enough anymore to watch out for innocent little kids...

You all should tune into CNN Lou Dobbs tonight...right now. He is going to have a panel to discuss the Judge's decision and role in this tragedy.

Lou Dobbs is the only good thing about CNN..

O' Reilly's on afternoon repeat. O' Reilly is ticked. March 2003, violates parole AGAIN, tests positive for coke, fail to pay court costs, Harry Rafkin despite pleas, lets him go, even though he violated parole AGAIN AND AGAIN AND AGAIN. O' Reilly: He's partially responsible for Carlie's murder." JUDGE HARRY RAFKIN. "an 11 year old slaughtered in the street because the Judges won't enforce the law. It's insane. Judges are there to enforce the law, not to let people with long rap sheets to run around. Obviously addicted, obviously a danger to society." O' Reilly's steamed. O' Reilly wants to slap the Judge silly. I know how he feels. THE JUDGES KNOWS HIS RECORD, IN FRONT OF HIS FACE AND HE LETS THE GUY OUT. It's on this Judge.

I agree with O' Reilly. FV

Everything that you SAID sounded awfully judgemental and blameful.

Actually to me it sounded like something a RESPONSIBLE parent would say.

It almost seems like the only remedy is to institute the DEATH penalty for child molesters and rapists.

I'd actually be all for it, even the second part whenever the rape is aggravated ( when the rapist not only threatens with a deadly weapon, but uses it to hurt the victim).

The criminal justice system ENABLED this serial predator and knife wielder to become worse.

The criminal justice system and the prison system are not designed to deal with predators, and it in fact, as you say, makes them both more capable and more dangerous.

Predators are uncommon, even in prison, although because of the perverse nature of prison they tend to rule the roost there.

Predators need to either be killed as soon as they are identified, or else isolated permanently in a non-prison setting where they only have contact with other predators.

Yes, I want something FIXED too. Carlie's natural father made a plea on air to Governor Bush to investigate the entire matter. I hope Fla. AG Crist or Governor Bush does launch an investigation.

For me the point is that the death makes it impossible for the criminal to re-offend. He can't be released for any reason, and he can't escape.

O'Reilly was furious. Tonight will be one of his best rampages ever. And deservedly so. This judge is a symptom of the bigger problem.

I don't want to heal. I want something FIXED. I people to stop letting the Joseph Smith's of the world off the hook.

When these judges, parole boards, and psychiatrists can be held financially responsible (aka sued) it will end. As it is now they aren't liable for their mistakes.

I think it should be public policy that every school is mandated to teach children SELF DEFENSE what to do if a stranger approaches, how to defend themselves, wether it's to run scream kick. They need to know all the lures from predators this should be part of the school ciriculum.

I agree with O'Reilly. Too many judges either do not enforce the laws or promote their own agenda. This Judge Rapking should be impreached.

The same goes for several other judges in Florida who have made outrageous decisions in the Terri Schiavo and the Kantaras cases.

He * was * arrested on a Baker warrant for the suicide threat. Then subsequently went into rehab. He was still on antidepressants and for some reason (that I can't fathom) hydrocodone.

The prescribed meds, BTW, are why the judge couldn't reasonably revoke parole for the failed drug test. The test wasn't specific enough to show he was using any inlelgal drug.

I just read the affidavit. There are new facts. It turns out Smith confided in another inmate and this person was the one to tell officers where Carlie was located. Smith did NOT tell them.

Too bad they didn't order a psych eval. Certainly a psych eval would have taken this guy off the streets. You can be a danger without being "insane".

Here is an article from the Herald with lots of history on Smith. It includes some previous attacks, and I think some mention of reasons for the outcome of Smith's parole hearing...
