Just heard on WCBS newsradio NY that CNN reports Carlie Brucia found dead in Sarasota.

You're probably right, and it's a damn shame. If it were up to me, I'd not only sling his a$$ into general population- I'd make sure that his cellmate was a 400 lb. guy with a daughter.
I'm absolutely heartsick right now. May justice be served, and may God comfort Carly's family and friends. Rest in peace, beautiful girl.

Again, nothing out of the ordinary. Coke charges don't involve violence. Florida favors drug treatment for druggies over incarceration. I don't think that's necessarily a bad idea -- except for the fact that druggies will do anything -- i.e., burglaries, robberies, to get money for drugs.

He may have been thinking about the thousands he owes the IRS and he was in default on another loan and his wife kicked him out of the house. The guy was never going to fit into society but he got plenty of chances.

THere is no healing with out justice. I haven't healed from 9-11 and I haven't healed from the stupid, stupid deaths of any of these children because I know that they could be avoided if this society wanted to do something about them.

He had over 17 arrests, some of them were for violence against women. I think it would have been a real good idea to look at HIS ENTIRE RECORD. THEY GAVE HIM CHANCE AFTER CHANCE.

FWIW, the creep was already free on parole.
The judge (when the facts of the hearing are reviewed) didn't have sufficient reason to revoke parole.
The failed drug test was attributable to Smith's prescribed medication, and this was investigated and confirmed by the parole officer.
The failure to pay court costs and fines gave the judge more chance for discretion, but under the circumstances he can not be said to have acted unreasonably. At least, he considered the same mitigating factors he would with any other parolee.
With no other evidence that Smith was violating parole (atying out late, using drugs, comitting crimes) it would have been very unusual for the judge to lock him up for being too poor to pay his fines, especially since he made regular payments while working.
THe judge found that Smith had not willfully refused to make payments.
Smith was unemployed and had no other means to make payments. He had made payments while employed. Smith had spent a stretch in the booby hatch and rehab, was on meds because of it, and had only been able to find spotty employment since.
I frankly think Smith's parole should have been revoked when he attempted suicide, but the judge did not have discretion to revoke parole for that.

Judge Rafkin got emails and calls that people want to shoot him. Judge says he "feels bad." He's afraid something's going to happen to his wife and his children. People are emotionally disturbed. He was put on TV and now he's afraid to walk down the street."

Smith SHOULD HAVE BEEN BAKER ACTED when he tried to commit suicide. Obviously, at that time, he was a danger to himself and as we now know, TO OTHERS. Nobody Baker Acted him. That's another outrage.

I totally agree with "Healing process is a little too p.c. for me. "
I don't want to heal. I want something FIXED. I people to stop letting the Joseph Smith's of the world off the hook.
I want guys who approach strange women on the street and clock them in the head with heavy objects, splitting open their faces, to get put into jail instead of diversion programs.
