What we have learned from the tragedy of Terri Schindler is that "appeals" means nothing in law. The "appeal" process cannot even correct errors in the original "finding of fact." The original court ruling is what endures. When appeals are successful, it is the "procedures" that were violated, not the disputed "facts" of the case. We need a reform to permit the appeals process to take into account errors in the original court finding. This is needed in all states, not just FL, where this tragedy will lead to a quicker disaster than we had thought a few short weeks ago. There is almost no way to discipline a lying, dishonest, or incompetent judge.

Yeah, Judge Greer is compassionate alright. He is compasssionate toward the plight of poor Michael who has had to endure the consequences of what were probably his own actions, who has in-laws that are trying to make his life hell, who has an inconvenient wife that is keeping him from going on with his life unless she dies and preventing him from laying his hands on the rest of her money, not to mention whatever else he might stand to inherit if she's dead. Poor Michael. That's where Judge Greer's compassion lies.

Exactly. I don't think the Judge said, "she has to die." I think he said, "you can kill her." He might not have used those words, but I believe that to be the gist of it. The order is posted somewhere on these threads. Hopefully somebody will do some digging to challenge this premise. That slimey, twisted little spiritual pervert is getting his jollies of all this.

You're right on in your observation of MS's selective "promise keeping". What about the part "to have and to hold 'til death do us part?"

It appears to me that Mikey boy thinks "to have" means that Terri is an object he possesses, and that "to hold 'til death do us part" means "strangle until death occurs". And if strangling doesn't do it, then starving and dehydrating 'til death do us part is the subliminal meaning.< /sarcasm>

There was nothing said on Oprah about Schiavo having starved and dehydrated his parents. It seems like the Schindlers would have tried to bring that point out, but again they don't want him to take away the visitation rights again. They are so bound by evil in this case.

To the best of my knowledge, this is the judge who originally ruled that there shouldn't be a change of venue, and then Bush appealed that ruling. When Bush appealed the ruling, this same judge issued a stay, saying that Schiavo's suit shouldn't go forward until the appeals court ruled.

Then Schiavo's lawyer appealed that ruling, saying that the stay was denying due process. So it would appear that, yes, Bush can appeal the decision not to grant a stay - that the same appeals court that will decide venue could decide whether there should be a stay.

I'd hate to have to make that kind of decision, but it seems to me like it's better to lose visitation rights for the moment then to lose Terri forever. They have to get whatever ammo they have out there if they want to win this.

I just received this in my email. This is the kind of moral reprobates we're dealing with.

Sadly, last month Terri Schiavo's prayer guestbook was desecrated with a hacker who put in porn and obscene references to Terri. Over 215 pages of prayers and well wishings from hundreds of loving individuals were destroyed. They would have been such a comfort to her family.

Now we have added a new guestbook, hopefully it will be secure. Please go to www.prayforterri.net and add in a little prayer for her survival and for her getting her much needed therapy. So many miracles have been occurring already! See Terri surrounded with protective and healing angels; see her becoming more awake and aware, and acknowledging all her warriors, both angelic and here!

Thank you so much for all your loving concern!

Hope she is on Terri's side and not the HINO's!

She really didn't seem to take sides. The only real sense I got was she did seem to think Terri was a little more "there" than a lot of people want to believe. She does indeed seem to have occasional awareness. Let's face it. She is pretty far gone and I don't know how much she can improve at this late date after not being worked with for so many years.

The bottom line for me is that she is a little "there" and even if she were a total vegetable, I don't think starvation is ethical.

Nobody has said, but my sense is that perhaps she could be spoon fed, but that it is probably a tedious process. The feeding tube makes things much easier for her and her caregivers. Not allowing her to try to take anything by mouth advances the agenda that she can't swallow at all. I know that she could probably aspirate her food if extreme care is not taken.

My overall sense is that the husband has orchestrated and controlled everything over the years so as to make his agenda more convincing.

Yes, appeals must be made on points of law, not disputed findings of fact. (too late for that)

Since Bush entered the arena, his attorneys may use, as a supporting argument, that certain findings are disputed (conflict of interest, abuse, neglect, hearsay evidence) and because her death would be the outcome of the court's ruling, and it would be permanent, that for all intents and purposes she is being subjected to a civil execution.

The same standards applied in death penalty cases (for hearsay evidence, admissibility, bias, conflict of interest) should be applied in this case. Not to do so violates Terri's right to equal treatment and due process.

The court case can't be retried but the new law may make the previous finding (in a similar way to post-conviction DNA testing overturning the trial court's conviction) it's possible the Greer ruling could be overturned.
