Judge Says Terri Schiavo Case Can Proceed


CLEARWATER, Fla. -- Saying that a brain-damaged woman's constitutional rights are being violated, a state circuit judge Friday rejected an effort by Gov. Jeb Bush to delay a challenge to a law that allowed the governor to order reinsertion of the woman's feeding tube last month.

Circuit Judge W. Douglas Baird, after a brief hearing, ruled that Michael Schiavo's lawsuit against Bush can proceed. He ordered an attorney for the governor to submit a brief by Monday defending the constitutionality of the law that allowed Bush to order Terri Schiavo's feeding tube reinserted Oct. 21.

Baird said Terri Schiavo's right not to be kept alive artificially was successfully defended by her husband in state courts, and any delays in removing the feeding tube so she can die are violating her constitutional right to privacy.

"The deprivation of this right is immediate, ongoing and presumptively unconstitutional," Baird said from the bench.

However, Baird said, the final determination of the constitutionality of the law will be made later after another hearing. It has not been scheduled.

Besides violating Terri Schiavo's right to privacy, Michael Schiavo's lawsuit against Bush contends that the hastily passed law that authorized the governor to intervene violated the separation-of-power provision of the Florida Constitution.

An attorney for Bush tried to block the lawsuit on procedural grounds, filing with the 2nd District Court of Appeal on Monday. That appeal triggered an automatic stay of Michael Schiavo's action, prompting his attorney, George Felos, to file a motion Wednesday to override the stay so the case can move forward.

Felos said Bush's appeal was a delaying tactic and Baird's ruling recognized that.

"We're obviously very pleased with the judge's decision to vacate the stay, and not only that but his acknowledgment of the facts in this case," Felos said. He called on Bush to abandon any further delays and allow the matter to be litigated.

Amy Quezon, who argued the motion on behalf of Bush, declined comment.

Officials in Bush's office have denied trying to delay the case, saying that they are just trying to make Felos follow the rules. They claim he failed to properly serve the governor with a copy of the lawsuit and that he should have filed it in Tallahassee where Bush is based.

Michael Schiavo has been fighting his in-laws, Bob and Mary Schindler, in court for years for the right to remove his wife's feeding tube, saying she would not want to be kept alive artificially. She suffered severe brain damage in 1990 when her heart temporarily stopped, cutting off oxygen to her brain.

Some doctors and a judge have ruled that Terri Schiavo is in a persistent vegetative state with no hope for recovery. Her parents, however, dispute those findings, saying they believe she could improve with therapy.

Florida courts had repeatedly affirmed the right of Michael Schiavo to remove his wife's feeding tube because he is her legal guardian.

What I'd like to know, is where this "presumptively" came from. This is a legal term, this is not a mere pejorative. Not even the droolingest ghouls on this board have ever argued that Terri's Law is "presumptively" unconstitutional without a trial on its merits. Felos is only Beelzebub. Baird is Satan.

Yes, what we could hear over the net sounded pretty balanced, some audience members asked very pointed questions, and Ms. Coleman acquitted herself well, what portions I could hear.

I can't find any streaming video on the BayNews 9 site, do you have a link?

Also, if you or anyone in the area was able to tape a clean copy off the TV, without all the commercial glitches we were getting online, PLEASE keep a copy of the tape, I would like to get a copy if it doesn't turn up online again.

The verdict first, then the trial?

My reply: Thi is so totally unbelievable. Ruling fist then trial?? What issssss it with Florida Judges? I don't get it?

Here in the Hinterlands I don't know it jsut seems like our judges are really "judges" . The Florida judges, one after another seem like they have an "agenda"? Is it jsut me?

Again if it is possible to re-call a Judge I WILL contribute money to a recall campaign. I would love to know if Judges can be re-called in Florida.

Also in this breaking news report "Judge also decided the case will be heard in Pinellas County" not in Tallahassee as requested by Jeb. What do we have here? We thought Greer was bad, do you think this one could be worse?? Does anyone know anything about this Judge Baird?

How can Baird be allowed to hear a case he has already decided? How can he vacate the stay when it's been appealed to the 2nd circuit?

This is totally insane.

Next he'll grant Felos' request to remove the g-tube before the case is heard.

What's the point of all these TV appearences when the outcome seems to be pre-determined?

I would like to think that seeing decent people make their case to the public would help. But at this point, I have no reason to think that.

I don't know anyone who has been "put out of their misery" this way - but if I did I think I would wake up screaming at night after reading Kate Adamson's story. "It was incredibly painful - sheer torture!"

I wasn't able to record the Tiger Club broadcast, but a couple things stick in my mind:

Felos admitted that Terri's rehab fund TRIPLED in size through the efforts of the GAL. Oh, and he's working for free now! He also emoted that it would be Sooooo unfair to MS to be condemned to a life of "loneliness" with an incapacitated spouse (though I didn't hear mention of the family Johnny Appleseed's been sowing) yet MS is still a loving husband! GAG.

Felos denied being connected to any 'group' supporting the right to die, bet he wished he could take back his words after his affiliation with SunCoast was brought out!

One question posed to Felos really seemed to frazzle him - he was asked why MS was pursuing Terri's death after all these years, why he didn't just hand over the keys to her parents, who love her and are willing and able to care for her?

Felos replied (BS alert) that it was "Terri's wish" and MICHAEL PROMISED HER (he would kill her?) so he was to carry out her wish.

Now, I might have missded it, but when did he PROMISE Terri he would starve and dehydrate her to death if she ever became disabled?

Another thing - the lady from Not Dead Yet, Ms. Coleman, said the disabled had been intentionally shut out from having their voice heard in the media.

On the whole, MS was viewed with suspicion. Conflict of interest and his financial stake in the matter were raised and rebutted by Felos quoting the Court's opinion that MS is a "model husband."

I caught that, too. Here's the whole quote in context:

Note - "presumptively unconstitutional". Do you see what Roe v Wade and the "right to privacy" has gotten us???

I'm convinced of that also.
He didn't have the audience in hand very well.
Maybe the folks that did hear will make a better informed decision against his cause.
Ms. Coleman did a splendid job.
She did not allow him to get away with anything.
Thank the Lord there are others coming on board to the cause of LIFE!

That actually happened here in California (Nicole Parra "Queen of Voter Fraud").

But seriously, Sweetliberty - This fight for the life of Terri reminds me of when abortion became legal by edict of the Supreme Court. The pro life side just keeps getting hit with defeat after defeat. Once in a while, there's a small victory. If they are successful in starving Terri to death, I am going to lose all faith in the court system in America.

Judges are now running much of this contry, making obviously illegal decisions. Yet they are getting away with it. Our emerging dictators: the Judges. Supreme O'Conner already said she wasn't about to follow the Constitution.

I share your prayer for Terri's life. But making a case to the American people is another matter.

The people spoke and Bush acted and bought a little time. Things do not seem to be going well in the court with its presumptive declarations.

I read this stuff about what's happening and although I know it's happening, there is a substantial part of me that just cannot believe it. The macabre insanity of the courts' actions defy belief.
