TERRI'S FIGHT(Daily Thread 2 - October 30-31, 2003)Link back to thread 1 - October 29, 2003
Contained in thread 1:
Summary of Terri's bone scan, transcript from "On the Record" response from Bobby Schindler and Attny. Pat Anderson to Michael Schiavo's appearance on Larry King Live, link to where to search public records for Pinellas County (for a fee), information on Terri's Lights, link to transcript from Larry King Live interview with Michael Schiavo and George Felos, synopsis of radio interview with Michael Schiavo's brother in Pennsylvania, summary of interview with Pat Anderson on Michael Reagan's show, portion of testimony from Schiavo medical malpractice trial, some links to information on the Florida death cult, names and email address for the Florida Supreme Court, information on previous GAL, Richard Pearse, Jr., information on GAL currently being proposed Jay Wolfson and links back to earlier threads on the case. Of course this overview isn't comprehensive, but my main point in this section is to provide easy reference to what could be important information. Also, links to other websites focusing on Terri's fight can be found in thread 1, here. Thanks to everyone for your contributions and for your dedication to this fight.

This thread serves as a place for posting all new general information and references, along with links following Terri's case, plus information on cable news and talk radio shows dealing with the issue, court cases and press releases. This is also the place to post contact information, prayers and general discussion.
FL_Engineer suggested that if you have something that qualifies as BREAKING NEWS or FRONT PAGE NEWS, please post it on a separate thread in that category in order to give it maximum exposure and then post a link to the article/thread here so that it will be included in the next update of links. Also, if you post links to articles from original sources and there is also a thread on FR, please link to the FR thread. Many original links become corrupt over time and we want to be able to access the information at will.

Yes! I thought there was some inconsistency there (where she was supposed to have 'thudded') - I'm glad someone else saw that too! The more people dig, the worse that ol' Mr. 'Schi'-ster looks...

Remember, there are lawyers working to save Terri, too.
I didn't mean the criminal justice system, I meant the civil system, where Michael sued the doctors, and where the doctors lawyers should have uncovered other causes for her condition.

Some will say your experience is the exception to the rule. Well, I have very similar experience and I'm in complete agreement with you.
Prosecutors (some of them) will select cases to prosecute on the basis of their caseload, the court's docket in their area, the case's political priority, the quality of the defendant's attorney, the so-called value to society of the victim's life, or the prosecutor's gut aversion to the crime or lack thereof.

Well, as a former insurance defense lawyer, I can see how this could have been overlooked.
Defense theories of the case tend to get crystallized early, probably by the adjuster. And once the theory is in the file, you tend to "see" things that support that defense theory and overlook others that don't mesh. If the neck bruises were buried in an ER intake report, and the adjusters and defense attorneys were running on a theory of bulimia or diet abuse contributing to her condition, I could see how everybody could look right past it.
In an ideal world, of course, the trial lawyers fly-speck every piece of paper in the file. As a practical matter in a busy office, the only person who ever looked at the ER intake report was probably the paralegal who Bates-stamped it while getting ready for discovery.
I try not to attribute to malice or evil what can be attributed to incompetence or carelessness . . . Occam's Razor and all that.

Our office is the flyspecking type, but I can see how your version of events could happen. If that is what did happen, and if Terri's family knew Michael was abusive and kept quiet to bleed the doctor, shame on them.

Very nicely linked summary of list one.
I certainly hope that the IRS has been making sure Mike is following all the rules when he files for himself and his wife.
I imagine there is a good deal of paperwork.

In every profession there are honest folks and there are dishonest folks.
The reasons behind a lack of investigation in criminal cases is bigger than the individuals involved. Since it would take three threads to explain, and would completely distract us from the issue at hand, the brief summary is "Blame the Democrats". (LOL)

I can also see a situation in which the parents were not aware that he was abusive. I have personal experience of this in my family - a relative said she was thinking about divorce, but never said a word about her husband beating her up regularly. It all came out later, through the testimony of neighbors, but her own family didn't have a clue, and neither did her best friend. She put herself in for a world of hurt by not speaking out, but I guess she was ashamed.
I was always the fly-specking kind myself (I've been out of the business 10 years now), but I hear that some insurers have started questioning every tenth of an hour billed and second-guessing the lawyers, to the point of not allowing defense attorneys to take necessary depositions. A lot of my friends are getting out of insurance defense because they don't want some non-lawyer bean counter in Adjusting directing the trial of the case.

Here's a piece of the LKL transcript:
http://www.cnn.com/TRANSCRIPTS/0310/27/lkl.00.html Schiavo: I'd say, about 4:30 in the morning, I was, for some reason, getting out of bed and I heard a thud in the hall. I race out there and Terri was laying in the hall. I went down to get her. I thought, Well, maybe she just tripped or whatever.
It sounds from this as if she fell in an area downstairs from the bedroom---or perhaps fell down the stairs. Note he says "I went DOWN" to get her. Maybe that's why everyone overlooked the injuries, it was assumed she was bruised in the fall, but the major concern was the life-threatening cardiac arrest.
Yet if that's so, that she could have fallen down stairs, why hasn't he said so, attributing the injuries to the fall?
None of which absolves him of 10 years of neglect and abuse.
To: TaxRelief
No, the incident was in 1990, February.

Even in his version on LK, he can't get it straight....

There was a case where Greer denied a protective order for a woman because there was no abuse, only threats and 2 weeks later she was stabbed to death.

I've been wondering how they got around the investigation especially after the bone scan. Statute of limitation or not someone dropped the ball when the accident happened or someone knew someone with a broom and a rug to sweep the dirt under. If it was a child it would have been a whole different story.
