Little-known rule could stop socialists from being sworn into Congress
Fox News ^ | 10/29/26 | Elizabeth Elkind

A little-known congressional maneuver could block members of the Democratic Socialists of America (DSA) from being sworn in as members of the House of Representatives next year, even if they win their elections on Tuesday.

Members-elect must swear an oath to uphold the Constitution before they can become full members of the House. At the beginning of a new Congress, that oath is typically taken en masse by all 435 members, led by the House speaker.

But an argument circulating in conservative circles posits that any member-elect can challenge another member-elect's right to be sworn in, provided they have compiled evidence that that person would not uphold their oath. That would then lead to House-wide deliberations followed by a vote on whether that member-elect has a right to be sworn in.

In the case of DSA members, one potential argument could be the group's platform calling to scrap the current U.S. Constitution and draft a new one. Several DSA members and self-proclaimed democratic socialists have already won primaries across the country.

Rep. Keith Self, R-Texas, suggested to Fox News Digital that he could invoke the maneuver.

"You cannot swear an oath to support and defend the Constitution while actively working to destroy it. The oath of office is not just words you say at a ceremony. It is a belief. It is an oath to our country and our fellow countrymen," Self told Fox News Digital.

"The House has both the authority and the duty to ensure that anyone who takes that oath does so in good faith, without mental reservation or purpose of evasion. As DSA candidates and the Red-Green Alliance gain ground, we must enforce the Constitution as written or risk allowing people committed to replacing it to take seats of power under false pretenses."

It's called the 'no commies will be sworn in' rule.

Good. Now they need to apply it to Muslims too. (And expel any of them that call for Sharia to become the law of the land.)

The ones that aren’t actually Muslim have their own form of taqqiya.

the duty to ensure that anyone who takes that oath does so in good faith, without mental reservation or purpose of evasion.

Taqiyya allows the Muslim to take this oath with a clear conscience. What do you do with that?

Yup; they call it “The end justifies the means”.

To think their party wanted to run a spoiled hypocrite First Female (most think) who complained about all the fuss over America’s flag. Good thing for us she prefers living it up on taxpayer’s money rather than serving in any office.

Sure, like many other rules and laws we have, they would make the US a great place if they were only enforced.

At what point is treason invoked? Sedition? The Oath of Office stipulating that the oath keeper (sic) "preserve, protect, and defend the Constitution of the United States..."

If we display absolutely NO courage in taking those words to heart and enforcing our laws, then, we are lost.

Adams said the Constitution would only suffice for a good and moral people.

Good and moral implies courage and commitment at combatting sedition and treason.

Which we now have in abundance.

The Second Coming by Yeats:

"The best lack all conviction, while the worst/ Are full of passionate intensity."

They have a clear conscience, but they are still liars and their own words prove it.

Yep. In reality our GOP pals would happily let them put their hand on an old Sears catalog and swear an oath to the Flying Spaghetti Monster.

The courts ruled way back in teh Adam Clayton Powell case tha tthe House cannot refuse to seat a duly elected member; they can, however, expel that person.

RE: ...expel any of them that call for Sharia to become the law of the land.

I wonder if the senate has a similar rule to the house? I’m thinking Abdul should definitely be blocked if he wins, on the basis of national security risk.

Could there be any republican senator who would step up, or will they remain Republicants. President Trump might do it.

It is amazing to me that this has become a little-known rule. Do we not have the will and the time to devote to caring anymore about the Constitution and rule-of-law? How far we fallen!
