The CEO of Buc-ee’s says the beloved convenience chain will focus expansion on conservative states as the beaver-themed brand faces scrutiny over its repeated trademark lawsuits.
Arch “Beaver” Aplin III, also the Texas chain’s co-founder, made the remarks last week during the grand opening of Buc-ee’s first Arkansas location in Benton.
"We have a lot of opportunities. We're growing. We're building in a lot of places, but when you find a conservative, business-friendly state with a phenomenal workforce, it makes a difference," Aplin said in a video shared by Arkansas Governor Sarah Huckabee Sanders on social media.
"And I'm starting to realize life's too short to try to build in places that people don't appreciate what you're bringing versus a place like this, where people do appreciate what you're building,” Aplin added.
He then explained that Buc-ee’s-worthy locations must meet three of the brand’s key values.

The one in Katy has (it seems) it’s own dedicated exit to get to it.
Buc-Cee’s is not just a quick stop for gas, drinks and snacks. Getting in and out of the parking lot can take 15 minutes some times.
But it’s worth it. It’s part of the road trip to be enjoyed.
When we’re ready to check out at a store we go to a lane with the least freaky clerk.
Perjury is basically an empty threat in these cases, as is a jury trial.
Few of these cases ever go to trial. Most are settled with a return letter saying that the accused will change their company name and logo. The rest a settled before it goes to court. Even fewer will go to before a jury.
As for being a victim of their lawyers, I see them as being lax in oversight and too quick to agree with their lawyer’s opinions.

Beaver Mart was in the Township of BEAVERCREEK (which was Beavercreek when Tejas was still Mexico) ... Buc-ees is the newcomer and needs to sit down, shut up, and show a little respect.

Have you ever been to Beavercreek, Ohio? I have ... used to live in Dayton. They have friggin' beavers on everything. Those jumped-up jackasses from out of town are the ones infringing.

People in CA buy stuff too, but they have driven out many businesses. Why do business in a state that hates you?

Did you see The Fat Electrician video that quoted the CEO of Buc-ee's specifically defending the lawsuit against Beaver mart?
Yes I did. What else would he do. After the fact.
But you are probably right that he is of the philosophy that is necessary to aggressively protect your trade mark.
It does not change the fact that this case is over the top and any reasonable person would not consider Beaver Mart a violation of Buc-ee’s trade mark.
Trademark law infringement cases are decided by a complex weighing of factors. Waiting to sue risks an adverse decision due to the equitable doctrine of laches. The law favors early and strong action instead of a wait and see approach.
A key factor in trademark cases in who has the earliest and strongest federal trademark registration, not who was first in existence as a business.
Anyone who claims the two logos are even remotely confusing is not being honest.

As for the legal issue, similarity of businesses and their presentation in the marketplace can make for trademark infringement even if names and logos are visibly distinct. The test is likelihood of confusion in the marketplace, without proof of actual confusion being required.
We've already dealt with that.
How much is Buc-ees paying you to shill for them?
People in blue states buy things too. That is why you do business there. Prices may be higher due to increased costs. A smart businessman will figure out a way to make money.
If you want a counter example, there is a large format Florida based gas and go operation similar to Buc-ee's that is called Busy Bee. So far as I know, they have had no trademark infringement threats from Buc-ee's, but Buc-ee's seems to be positioning new locations as if to cordon off Busy Bee from expansion.
Never heard of them. Wonder if they’ll buy a pro football franchise, and get all the tax breaks, red or blue?
