Months before the Supreme Court ever ruled, I had a feeling exactly this would happen. An executive order was never going to be strong enough to permanently fix birthright citizenship, no matter how good the intentions behind it were. That's why I filed a constitutional amendment early this year instead of waiting around to see how the courts would rule.
This decision confirms what I already suspected. If we want real, lasting change, it has to come through the amendment process.

The Supreme Court just ruled that, apparently, immigration IS a suicide pact. It has struck down Trump's birthright citizenship executive order and chose to distort the single most important phrase in the 14th Amendment: "and subject to the jurisdiction thereof."
When the Republican Congress drafted this amendment after the Civil War to protect freed slaves from the Democrat Party's terror campaign, they inserted that phrase for a definitive reason. It was meant to cover people who owed FULL ALLEGIANCE to this country. It was never written to create automatic citizenship for children born to people who enter our country illegally, or who come here on tourist visas just to give birth, or are part of a mass surrogate campaign run by the Chinese Communist Party to increase its influence over America.
The authors of the 14th Amendment would never recognize what the Court did today. They have taken our constitutional compassion, born of justice and mercy, and twisted it into a weapon against us. It makes absolutely no sense.

Two huge losses today. “Disappointed” doesn’t begin to cover it.

Could congress just pass a law or does it need to be a constitutional amendment ? Because if you need to change the constitution, that’s simply never going to happen.
The President has existing tools in the toolbox to stop this..Freeze visas for all “health issues”- including pregnancy. and freeze immigration.
Also notify border crossers that any child born in the US by an illegal will be taken from the parent and placed in foster care. Or they can go back across the border with their offspring.

I will support the presidential candidate that will end all immigration. There are enough Americans to do the jobs, plus AI and robots.
The issue then becomes whether the child leaves with a U.S. b.c. per the USSC ruling.
As much as Rand Paul annoys me, he’s incredibly correct. I wish there was a way that they could ban EO‘s. two presidents in a row have basically run their presidency through executive orders. I’m pretty damn sure that is not how the founders envisioned the use of them.
This was an absolutely horrible political decision totally at odds with both the wording and intent of the 14th Amendment.
I really have no idea why RP gets such push back. He is usually correct. You may not like that he is correct but there it is.

If that’s the case it’s a complete lost cause. Might as well just shut down all immigration

Not so. We can wait for retirements or pack the court, confirm better justices, and and petition for re-hearing. Meanwhile, birth tourism can be banned and criminalized.
