Only thing is Jacob wasn’t in Florida, he was in Alabama.

That's Pensacola resident Jacob Rockwell.

He was out of town in March and someone else was borrowing his vehicle. Rockwell doesn't dispute that this other individual ran the red light.

His problem is the seemingly-insane bureaucratic process to try and prove that he wasn't the one driving.

These things have been deemed unconstitutional for this reason: because the enforcement action of 316.083 unduly shifts the burden of proof to the vehicle owner, me, to prove my innocence, rather than the State having to prove my guilt.

Currently, I am guilty by default. I've been convicted by a computer program.

Usually, this whole mess of who committed by a police officer pulling somebody over and actually witnessing them in the driver's seat. The AI camera doesn't do any camera verification whatsoever.

To get your constitutionally mandated due process, you have to jump through hoops put up by Automated Enforcement Division, a private company in Orlando that's owned by another corporation called Novoa Global, which is owned by a Chilean-Swedish millionaire named Carlos Hoffstead.

If you wanna fight this think because you were wrongly accused - me again - you can't just request a hearing through [Pensacola] PD or the courthouse.

Officer Mike Wood of the Pensacola Police Department says the system isn't that bad - that you just fill out an affidavit with your info and the name of the other driver as part of that process.

Officer Wood did not, however, explain why American citizens should bear the burden of proof with a mountain of paperwork, or what you would do if an unknown thief had stolen your vehicle and proceeded to rack up numerous traffic fines.

This Big Brother surveillance is un-American. It's China-esque, and none of the voters asked for this.

Officer Wood says its about saving lives and "to get people to conform," which, you know, is also what China says about their mass surveillance programs.

Not a traffic violation.

If it's not a traffic violation, then why the charge?

Parking and tolls are not safety issues but these red light cameras were justified as a safety issue.

So the fine isn't a fine but instead is a toll for your car being used to drive through a red light.

I saw a car stop early for a yellow and the car behind hit him....

That's why the red light cams got thrown out by courts in Illinois: statute says it must be for traffic safety, but the accident rate went up. Plus they deliberately shortened the yellow light times to collect more money. Scum.

It’s a bigger problem in Texas, which simply has flat printed license plates, black letters.

You can just find your car and print a plate that matches and burn through tolls all day long.

I found this out when my fleet vehicles (white pickups) were getting toll fees in Dallas while sitting in Stanton Texas. We had GPS to prove it. Someone had driven by the yard and just copied down the plate numbers.

The most absurd claim about automated traffic enforcement is that it’s about safety.

They have hundreds of millions of pics of vehicles committing violations, yet not one pic of an accident.

If this were a scientific experiment and the only data you had was the ATE violations, you’d have to conclude that speeding and red light running is 100% safe.

They wouldn't need to raise money for the cameras if they weren't installed.

As for discouraging red light running, that's what moving violations are for.

In Tennessee if you get a “citation” issued by a computer linked to a camera, you can just ignore it because it is totally unenforceable.

The fact they can’t prove anyone was the driver is why these don’t get applied to anyone’s driving record. So its a risk they’re asking us to accept if we loan our vehicle out.

They tried them in California and had the same problem. Just like guns don’t kill people, people do, cars don’t run red lights, drivers do, and people would come to court, say they weren’t driving at that time, and get off. So the state stopped enforcing them. Then the private company running the cameras would send a “ticket,” but there was no way to enforce it so everyone knew to just toss them. After a few years they gave up.

Automating punishments is not a good idea. In this context, there must be a human in the loop that can ascertain if you’re the driver.

I’m sure AI will make this harder to argue but I think a more general bill should be passed against “automated punishments” in general, there’s just too much that can “automatically” go wrong.

Time to monitor congress? I say the have one in their office, how about teachers? The could have cameras in the classroom so we could watch our child during class.

Sorry copper. My tax dollars pay law enforcement to investigate violations of the law. If you expect me to take the time to do your investigations for you, please refund the taxpayers that portion of your salary for them doing your work.

If you have evidence that a driver violated a provision of the traffic code, it's law enforcement's job to identify the suspect, and develop evidence that they committed the violation beyond a reasonable doubt. The vehicle owner is under no obligation to do your work for you, assist you in doing your work, or sign an affidavit to prove they are innocent. It's your job to prove the guilty party guilty.

I feel with each passing day that we are living more and more in a police state. Upstanding responsible citizens are intentionally being criminalized and targeted in name of revenue. Besides red light cameras on every other corner in my area there is a police car waiting to “catch” you- just for the revenue- they won’t actually try to target the reckless speeder- they won’t exert any effort for truly unlawful and cant be bothered to chase them. Just looking for easy sucker to catch and release. (Also- Much of ticket fee from red light cameras goes to processing companies out of state- it’s a very hands off passive income for municipalities. Where I live they now have them in EVERY school zone with very misleading signage as to when they are active- some are active in school zone 24/7 AND don’t let your foot rest on pedal or tire AND synchronize your clocks because you will be fined for ONE MPH over at end of zone AND for ONE minute in time frame ie if you think it’s 2:31 but it’s 2:30- ticket ). It’s wrong.

“in Tennessee, standard traffic camera and red-light camera tickets are effectively non-enforceable. Under state law, these citations cannot be reported to your insurance provider, will not add points to your driver’s license, and cannot impact your credit score or prevent you from renewing your vehicle registration.”

But they are enforceable in a designated school zone.

It’s just a money making fining mill.

To get more violations, they reduce the timing of the yellow light. The municipalities claim that this is done for safety, but has the result of local people slamming on the breaks on the yellow light resulting in more rear end accidents. It’s been proven.
