WASHINGTON, Nov 24 (Reuters) - The Pentagon on Monday threatened to recall U.S. Senator Mark Kelly, a retired Navy captain, to active duty status in order to prosecute him after what it described as seditious behavior by the former astronaut and decorated veteran.
Kelly, who denies any wrongdoing and who said in a statement he would not be intimidated, joined five other Democrats in Congress with backgrounds in the U.S. military and intelligence community to urge U.S. troops to refuse any illegal orders.
Kelly's November 18 video message came amid heightened concerns among Democrats, echoed privately by some U.S. military officials, that the Trump administration is violating the law by ordering the U.S. military to kill suspected drug traffickers in strikes on their vessels in Latin American waters.
The Pentagon says those strikes are justified because the drug smugglers are considered terrorists.
The Pentagon statement said it was reviewing "serious allegations of misconduct" against Kelly. While it did not say what charges Kelly could face if it took such an extraordinary step, U.S. Defense Secretary Pete Hegseth posted remarks on X accusing Kelly and the other lawmakers of sedition.
"The video made by the 'Seditious Six' was despicable, reckless, and false," Defense Secretary Pete Hegseth said on X.
"Encouraging our warriors to ignore the orders of their Commanders undermines every aspect of 'good order and discipline.'"
President Donald Trump has also accused Kelly and the other Democrats of sedition, saying in a social media post that the crime was punishable by death.
Under the Uniform Code of Military Justice, sedition and mutiny are among the most serious offenses and can be punishable by death.

gotta say..ive never seen the democrats so rattled by this..they are freaking out. Kelly stepped in it and he knows it.

I thought Kelly was a pilot. He was not a JAG, so he has no business ‘advising’ military personnel about orders from the Commander in Chief. If a person in the Military believes that an illegal order has been issued, then he can bring it up with the JAG, but he better be right. Captain Kelly believes that he is better suited to render legal advice than JAG. For that, he must pay consequences for his actions.

This should be done and put on pay per view. Give the people an education on how military tribunals work.
The JAG’s real job is to protect the Commander. Average Soldiers can’t even get the time of day from them.
There are only lawful and unlawful orders. Encouraging military members to substitute their own judgement or bias is mutinous/seditious etc. Sad part, except for this ahole the guys going down would be the fools that listened to this group. I’m sure they will be available to console the NoKs.

He didn’t say he would, he urged current military members to disobey illegal orders, without saying anything about what will happen to anybody who disobeys an order: in order to be acquitted by a court-martial, the Accused would have to prove that the order was illegal - a very high bar. The statement itself is just a restatement of the requirement to obey even orders with which we disagree, but it’s dangerous for the members who are likely to substitute their judgment for that of their superior officers.

I’m going to cite a couple examples where judgment was used.
At abu graib a dog handler was ordered to use his dog to intimidate the prisoners and he refused.
Some of lieutenant calley’s soldiers refused his orders and threats or court martial

Both of those things took great courage but were also completely supportable. When they’re encouraged to second-guess orders that they think are subject to interpretation, it endangers them and their unit (hesitation is deadly).
