A federal judge on Friday ruled that the Trump administration’s attempt to deploy National Guard troops to Portland, Oregon, was unconstitutional.
On Sunday, US District Court Judge Karin Immergut, a Trump appointee, temporarily extended an order blocking the administration from deploying troops to The Rose City, saying the government failed to justify the move.
In the Sunday evening order, Immergut temporarily blocked “Defendant Secretary of Defense [Pete] Hegseth from implementing” memorandums that authorized the federalization and deployment of National Guard members from Oregon, Texas and California into Portland.
The injunction remained in effect until Friday.
Friday’s 106-page ruling makes the order permanent.
It followed a three-day trial over whether protests at the US Immigration and Customs Enforcement building in Portland warranted use of the military domestically under federal law.
The administration said the troops were needed to protect federal personnel and property.
Immergut said in the ruling the “evidence demonstrates that these deployments, which were objected to by Oregon’s governor and not requested by the federal officials in charge of protection of the ICE building, exceeded the President’s authority” because he wasn’t able to demonstrate there was a rebellion or threat of rebellion that couldn’t be enforced without the military.
The judge added that “even giving great deference to the President’s determination, the President did not have a lawful basis to federalize the National Guard.”

all these ridiculous judges will be reversed, but the leftist cancer is in deep in our judicial system and they will all be promoted when democrats get in again.
He waited to the last day of the temporary injunction before making it permanent indicates he is slow walking. It makes me think he knows it will be overturned.
Deploy anyway..there’s a technical error. Defendent Hegseth is the Secretary of War not Defense.

Other than the rabid communists, it’s doubtful that anyone would shed a single tear drop IF these demonic basstids just somehow managed to “disappear into the night” for some unexplained reason....never to be seen or heard from ever again...just sayin’. Spit.

Methinks some of these injunctions is to help evil doers get away.
OK, then deputize every Guardsman into the U.S. Marshals Service and send them in in that capacity.
If only the judges had read th constitution. Trump is CnC and has plenty of precedent to send in the guard.

Correct. In the Sick Sixties, the Guard was called out frequently to put down Communist-organized riots throughout the country.
Since 1963, 75% of all nationwide injunctions have been against President Trump.
90% of those injunctions came from Democrat-appointed judges.
Yet the Admin has a 92% win rate at SCOTUS.
President Trump isn’t the one abusing his power. It’s Democrat-appointed judges.
Yet another judge likely with a correspondence “degree” in law from Howard U. So many clowns...so little time.
Donald, just in case you read this, merely add a well-armed security section to ICE deployments. They would be ICE employees rather than National Guard; but, still tasked for providing security during ICE operations.
Watching a few news clips of the "mostly peaceful" riots would cure that.
