Two staff members at a nursing home in Texas have been indicted for allegedly letting an elderly woman freeze to death during a winter storm.
Cynthia 'Cindy' Pierce, 73, died of hypothermia after being rushed to the hospital in Austin on February 17, 2021, with her body temperature reading 94.2 degrees, according to court documents viewed by Daily Mail.
Care staff at Renaissance Austin Assisted Living Facility allegedly left her window open after changing her out of soiled clothing and bedding the morning Winter Storm Uri hit the city.
When they left the room, the window remained open and staff did not check on Pierce until the afternoon, the documents say.
The facility lost power during the storm, and the Pierce family accused the nursing home of not taking appropriate measures to ensure the older woman was taken care of and failed to restore power to the building.
On Thursday, Harvest Renaissance and its executive director, Mendi Ramsay, and wellness director, Rochelle Alvarado, were indicted by the Travis County District Attorney's Office for failing to 'promptly move and transport an elderly and disabled resident.'
The DA's office said the facility had a warmer area available to move Pierce to, but failed to do so.
The facility also allegedly failed to notify Texas Health and Human Services Commission of the power outage, the indictment said.

Bad. And the courts will figure it out esp w Ken Paxton in charge
Look at the date. Feb 17, 2021. That was a Wednesday. On the previous Sunday Valentines Day that year, we were starting the coldest day ever in the decades I’d been in Texas
These nursing home people can be awful but it was single digits here
They’ll be charged. But it was unusual
“These nursing home people can be awful but it was single digits here”
Coldest day of the year and those idiots open the window of her room then leave it open for what ever reason? Are they freaking retarded and I mean that in the clinical sense.
My dad was in Hospice in 2019, I remember walking by another room with an alarm sounding and it being ignored by the staff. When I brought it to their attention, they said the lady intentionally caused the alarm to go off.
The care facility had “nurse assistants” which I came to believe were minimum wage support used to watch over those on their death beds.
“Coldest day of the year and those idiots open the window of her room then leave it open for what ever reason? Are they freaking retarded and I mean that in the clinical sense.”
That would be the most innocent explanation.
Children should take care of their parents, period.
Surely at least one of the kids have enough room in their McMansion to house their parents.
My sister was complaining to me about her mother in law’s nursing home, she believed they killed her MIL.
I said give me the name of the nursing home, because if I’m ever forced into a nursing home I want that one.
Without quality of life I don’t want to be here.
This raises things that should be evaluated when selecting a care facility — what measures and plans do they have to care for residents during emergencies? Do they have an emergency generator? Will patients be moved to a safe area?
This saddens me. When my uncles put my grandmother in the nursing home the last thing she said to me was, “I’m not staying here”. She died 2 or 3 days later. Farm lady her whole life. Free...
I can tell you as someone who was present for a number of emergency drills, planned and unplanned, at a local assisted living facility, that loved ones need to be familiar with the protocols, and have a backup plan in place in the event their loved one should be moved.
Whoever is responsible should be fired and prosecuted to the fullest extent of the law.
Exactly.
That was also the day that old wind bag died
Leaving the care of loved ones to strangers is not a good arrangement.
RIP, poor lady.
Agree
Maybe she complained about the care or someone stealing rom her. This should be investigated as possible intentional abuse.
Sound familiar?
Aw, man…😢
