An ongoing national legal dispute regarding vaccinations of children with COVID-19 shots concerns whether school officials are immune from traditional legal claims -- particularly, battery -- when administering Emergency Use Authorization (EUA) shots without parental consent. North Carolina’s Supreme Court recently ruled in favor of parents for violating their informed consent rights in violation of a state statute. Still, even that court denied common law state claims for battery -- the physical touching of another against their will. The mainstream media has gaslit parents, claiming that public schools cannot legally force-vaccinate their children. But unless the child suffers serious bodily injury or death, they most certainly can under current rulings.

I represented the Politella family before the U.S. Supreme Court, which on February 24 declined to hear our Petition for Writ of Certiorari challenging a Vermont Supreme Court ruling that my clients, whose six-year-old son was vaccinated with a COVID-19 shot despite their clear wishes that he not be, had no right to sue for common law battery. Vermont’s Supreme Court decided that my clients’ rights are eclipsed by the federal Public Readiness and Emergency Preparedness (PREP) Act, which provides legal immunity to pharmaceutical companies and those administering shots related to these experimental vaccines. The Act allows a federal administrative remedy only in the event the shot is 1) administered “willfully,” and 2) causes “death or serious bodily injury.”

In the absence of the PREP Act, parents could sue for traditional damages if their child is given medical treatments without their consent. The Vermont Court did not consider constitutional liberties to parental control or bodily integrity. This led to claims that the court’s ruling would permit forced jabs

With what is now known about the COVID jabs, I am surprised this is still an issue. It just proves that the mandates were only about government power the whole time.

We need to repeal the PREP Act.

That should be one of our highest priorities.

No child should receive the COVID shot. They are MUCH more likely to die from the shot than the disease.

Does this judicial system have the right to make insane, anti constitutional decisions? Do parents and their children have the right to privacy? Do they have the right not to be assaulted with a deadly weapon? Or assaulted at all? Yes. Who is going to asserts that right? Wimpy parents who refuse to pull their kids out of these insane institutions? No.

They had to have parent’s consent. I had a polio shot, TB shot and smallpox. They were real vaccines, proven, tried and true. One shot, no boosters, and I don’t remember any bad after effects anyone had. Not the same as the phoney baloney crap their pushing today. Flu shots included. No one can tell me they know how a flu strain will mutate a year after they make the so called vaccine.

IIRC it wasn't a shot, it was a teeny cup with pink liquid and each student was given a teeny cup to drink, it averaged out to just a sip.

Thats not the issue. Its forced medication that is the issue.

Despite the fact that I worked with people with violent mental health issues that could be a danger to themselves or others, I could not do anything to “make” a person take medication. It is their “right” to refuse.

That is to say that a person that has already been judged by the courts to not be competent to make their own decisions is allowed to make the decision weather medication would be helpful but a child with competent parents cannot make the same decision.

Regardless of whether a particular vaccine works without harmful side effects, there’s no need to make vaccines mandatory for most citizens. People who think they are needed can protect themselves without forcing others to take them. Most Americans don’t have enough stake in each other’s health to warrant making vaccines mandatory. There are extreme cases, such as soldiers fighting alongside each other, or the single mother whose kids will go destitute if she catches Typhoid, but they dont justify universal compulsion.
