U.S. District Judge Amy Berman Jackson Rules the Bureaucracy Controls the Executive Branch, Not the President

Not unexpectedly, U.S. District Judge Amy Berman Jackson has ruled that unelected bureaucrat, Hampton Dellinger, the U.S. Office of Special Counsel head has more unilateral power within the executive branch of government than President Donald Trump.

This ruling stems from the same mindset as former AG Bill Barr, former FBI Director James Comey, former Deputy AG Sally Yates, former IC Inspector General Michael Atkinson, and the entire organization of professional Lawfare activists that includes Mary McCord, Andrew Weissmann and Norm Eisen. The collective belief is that in the modern “continuity of government” framework, the bureaucracy of government controls things, not the elected and plenary President.

Basic constitutional civics has been destroyed in the modern era by progressive advocacy saying the executive branch is an omnipotent organism that is not controlled by the duly elected President of the United States. Current Lawfare activists and activist judges seek to retain this bastardized view of constitutional government.

Let us hope the Supreme Court finally puts an end to decades of this ridiculous nonsense. The earlier ruling in the Presidential Immunity decision indicates SCOTUS is positioned to do exactly that.

At some point, Trump will have to have the Solicitor General file an emergency motion with the U.S. Supreme Court to counter district judges blocking his executive actions.

It is my understanding (as a non-lawyer) that, if the Solicitor General argues that the judicial injunctions are causing nationwide paralysis, the Supreme Court could grant a blanket stay on all related rulings, effectively suspending lower court injunctions while litigation continues. This would allow executive orders to take effect immediately and remain in effect until the Court issues a final ruling on the merits.

If the Court views the district rulings as judicial overreach interfering with the President’s constitutional powers, it could decide to hear the cases immediately.

Trump’s legal team needs to ask judge what exactly constitutes firing with cause? If she can’t answer that question, she can’t stop Trump from firing Dellinger. If she says that a court ultimately determines the firing decision, she has grossly overstepped her authority.

I recall that sometime in the 90s I read that in France the most plum career aspiration people have is to get a cushy government job where they get massive benefits, high pay, and a lot of control over everything. I recall thinking that this is why France likes to think it's a big boy on the world stage but really is just a minor player - they are in a society where people's biggest goal is to be unproductive leeches.

Back then it was close enough to Reagan that I was still basking in the glow of that and not realizing that the Bushes were coordinating a conversion of the GOP into a globalist sidecar to the democrats whose purpose was to create the illusion of two parties and a viable opposition to the left. But look how huge the deepstate has become once you shine a little light on it.

Live appointed judges along with the can’t fire Federal employees need to be completely scrubbed. Congress needs to start looking into a bill to put term limits on those POS corrupt judges and unproductive employees. Impeaching judges takes too long and is tedious but Congress can’t write a bill advance it to the Senate pass it and then president signature can sign in lightning speed. There is a constitutional crisis going on and it’s beginning to bubble from underneath and quickly boiling over into a major constitutional crisis. If the Supreme Court doesn’t nip it speedily in the butt it is going to get dangerously bad for our country!

FR: Never Accept the Premise of Your Opponent’s Argument

If this were a better world, and noting that Section 3 of the 14th Amendment (14A; removal for rebellion) doesn't require a supermajority of either House, if that's how that section works, then congressional majority RINOs should be removing the judge from the bench for open rebellion against the president's constitutionally enumerated duties imo.

Could it be that PDJT47 is not strictly applying Section 3 in the name of national unity? That may ultimately prove to be wiser choice if so. Trump is exceptional at negotiating win/win deals imo.

Also consider the federal law, seemingly based on 14A, that prohibits weaponization of the law which Constitution-ignoring leftists will undoubtedly whine that it's being weaponized against them.

18 U.S. Code § 242 - Deprivation of rights under color of law: "Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death."

Trump-supporting patriots have one more try to send elite RINOs and desperate Democrats home in 2026 so that PDJT will finally have a Congress that will support a Section 3 clean sweep of deep-state judges in his last two years in office.

I've read that there are over 100 lawsuits now . With over 800 judges , any of which can crown themselves King , you got a real mess! While Impeachment will embarrass them, it won't get rid of them. Dissolving their court from underneath them, however , can be done with a simple majority.

I suggest the DC Circuit first. They railroaded the J6 political prisoners. Doing this would also have the beneficial effect of making all the other would be black robed imperials think twice before self assuming power.
