How Does Birthright Citizenship in the U.S. Compare to the Rest of the World?

Who gets to be an American? Since the 14th Amendment to the Constitution was adopted in 1868, the answer to that question has been cemented in the American psyche: anyone born on U.S. soil is a U.S. citizen. That is until Donald Trump issued an executive order on Jan. 20, 2025—the first day of his second term as President—that would make birthright citizenship conditional on the legal status of one’s parents, targeting many of the hundreds of thousands of children born each year to immigrants. The order was immediately challenged as unconstitutional and is expected to be held up and potentially blocked by the courts before it can go into effect. But just how radical is the idea of limiting who can be a citizen? The U.S. is one of around 30 countries that follows the principle of generally unrestricted jus soli, meaning “right of soil.” This has allowed millions of people each year to automatically become American citizens irrespective of their parentage. Under Trump’s order, which is set to take effect on Feb. 19, at least one parent must be either a citizen or a lawful permanent resident for their U.S.-born child to become a citizen.

"Across the world, birthright citizenship is not considered the norm. Canada and Mexico have unrestricted birthright citizenship, as do a majority of Latin American countries. But across Asia, Europe, and Africa, almost none do—at least without similar restrictions to what Trump is proposing."

If two illegal aliens have a baby in Canada, that baby will be a Canadian citizen...

I agree with President that present US law about citizenship should change...Many other countries have citizenship laws similar to what President is proposing...Including Australia and Great Britain...

My niece was born in NZ. However, she was not entitled to citizenship because neither of her parents are NZ citizens.

Say what you want about New Zealand and how leftist they are, they keep a tighter grip on who is allowed to enter and stay.

It actually would not be a problem were it not for handouts.

Get government out of the charity business and almost all of the country’s problems disappear.

Only "Time" and the Left care about that. The U.S. gov't is under the Rule of the Supreme Law of the Land - the Constitution (Art. IV., Cl. 2) - whereas the world is under the whims and cunning craftiness of the Rule of Man.

We are the leaders, not followers, of the rest of the world.

Native Americans weren’t automatically considered American Citizens until 1924 so clearly the 14th amendment didn’t make everyone born on America’s magic soil a citizen

There is a reason for that. At that time, Native Americans were considered to be citizens of a Tribe not citizens of the United States...and that is how they wanted it, I think.

Illegal aliens are citizens of a foreign country not of the United States so logically their children should not get automatic citizenship.

No it’s not about the parents who are IMMIGRANTS

It’s concerning the parents who are illegal aliens

The opposite of "jus soli" is "jus sanguinis" or "right of the blood" - meaning a child follows the citizenship and jurisdiction of the father (and now often mother)

All major countries follow "jus sanguinis" with regards to offering citizenship. Some, like Germany and Japan, even to what we would consider extreme degrees - I know a guy from Brazil who carries a German passport, simply because his great grandfather was from there. Interestingly, his sister can not.

the US policy, twisted by Democrats of birthright citizenship, even for illegals, is outright absurd.

I don’t believe the author. Mexico is tough on immigrants. Especially Ameicans going south. Can’t own land, can’t vote, etc.

It was addressing the newly freed slaves. Technically voiding Dred Scott decision.

At its inception American Indians weren’t given the same status since they were considered citizens of their tribes.

Many European countries welcome descendants of former citizens. E.g. Italy or Poland. If you can prove that somebody from your family was a citizen, you will qualify automatically.
But if you were born there, tough luck! You need to prove your ancestry!

WTF?

It is totally irrelevant how it compares to the rest of the globes countries...

Nothing about any part of our former Republic depends, or relates to, the rest of the planet...
