WASHINGTON (AP) — Donald Trump “resorted to crimes” in a failed bid to cling to power after losing the 2020 election, federal prosecutors said in a newly unsealed court filing that argues that the former president is not entitled to immunity from prosecution. The filing was unsealed Wednesday. It was submitted by special counsel Jack Smith’s team following a Supreme Court opinion that conferred broad immunity on former presidents and narrowed the scope of the prosecution. By refiling and saying this was ‘after’ he lost the election that Trump’s ‘crimes’ were not ‘while in office.’ It’s a fake gambit hoping the judge will actually try and make believe it is so. He WAS ‘in office’ until January 20 and ‘sitting.’

"With private co-conspirators, the defendant launched a series of increasingly desperate plans to overturn the legitimate election results in seven states that he had lost—Arizona, Georgia, Michigan, Nevada, New Mexico, Pennsylvania, and Wisconsin (the “targeted states”). In most instances that I quickly read, Trump is conversing with staff, advisors etc...Any and all of those conversations are subject to immunity.
And there is a big difference between questioning the outcome and "establishing himself as President" rather than Brandon.
