Elon Musk’s Supreme Court petition is a window into how a leftist 'justice' system works

The special prosecutor’s overreach and the trial judge’s open bias are equally disturbing.

Just when you thought the “swamp” judicial system could sink no lower, an Elon Musk-X petition to the Supreme Court reminds us about Jack Smith’s and a leftist judge’s complete disrespect for Americans’ constitutional freedom from intrusive government searches.

The information emerges in X Corp.’s petition for a writ of certiorari relating to a court order arising from a search warrant that special counsel, Mr. Jack Smith (yes, that one), served on X demanding data and records from former President Donald Trump’s Twitter account. The problem from X’s viewpoint was an unusual attachment included with the warrant: A nondisclosure order blocking Twitter/X from disclosing to former President Trump the fact that the government had seized his records.

SNIP

Last week, X Corp petitioned the U.S. Supreme Court to review a trial court order that allowed government prosecutors to include an enforceable non-disclosure order as part of a search warrant.

However, the government’s bad behavior isn’t limited to the non-disclosure agreement. When X originally challenged Smith’s order, arguing that it violated both X’s and President Trump’s First Amendment rights, as well as Trump’s executive/presidential privileges, U.S. District Judge Beryl Howell was having none of it. What’s really amazing is her stated reason for refusing X’s petition:

X challenged the order, arguing it violated its First Amendment rights and noting that President Trump might have reason to claim executive privilege, or presidential privilege. The company wanted to alert the former president so he could assert the privilege, but U.S. District Judge Beryl Howell ruled against it, claiming during a hearing that the only reason X was issuing the challenge was “because the CEO wants to cozy up with the former president.” (Emphasis added.)

This gal has, of course, previously been in the news (August 9, 2021) for other authoritarian rulings and remarks:

“A federal judge [Beryl Howell] suggested Monday that federal prosecutors were being too lenient in their handling of cases stemming from the storming of the U.S. Capitol as lawmakers were convening on Jan. 6 to certify Joe Biden’s victory in the presidential race.”

A typical D.C. feral judge.

They have no right anywhere in American law that the victim of a search warrant must keep it secret. The government has no right to demand that a person keep secret that cops have stopped by to interview them.

So far the courts have ruled otherwise.

Richest man on earth on any given day. Might not be him that winds up in that car. Mega-money can make things happen. He seems like a nice guy, but make no mistake, he has world class former delta security that loves their paycheck. And if HE decided to reach out and touch someone, he could do it.

People going after Elon love their yachts on Chesapeake bay. I bet Elon could find some patriotic ex SEALs … if he needs help. Shame the poor guy on that boat didn’t run the engine ventilation fan before starting the engine. ..

That’s just me. Elon is way smarter. He could probably find out the filth on anyone coming after him and ruin them if he pleases. But I think he likes toying with them.

He really is 4d chess. I can’t talk about the search? Ok, I’ll find an appeal to the Supreme Court to argue about and talk about the search warrant I can’t talk about.

I don’t think Elon is a “wet job” kind of rich guy, but I imagine he has a much better legal team than President Trump.

True. But that’s just revolutionary courts. AFAIK, only grand jury testimony is secret. This is an active criminal case and they are hiding what was seized in a warrant secret from the defendant.
I know you were merely commenting that courts are supporting this lawlessness. But this is going to have to have a serious rollback.
Anyway, Jack smiths days are numbered. He was illegally appointed and is likely to be removed. The beady eyed Dutch weasel.

It would do everybody well to remember that Elon Musk (an actual Afro-American, by the way), while a multibillionaire, has a total net worth that is finite.

But that can’t compete with a government, for all intents and purposes, has literally unlimited resources.

No expense will spared to bring the “seditionists and insurrectionists” to justice . . .

Gnats in his ear. And that just for public consumption. He has massive DOD and CIA contacts for space and data. He’s sage and he knows it.

Fully agree. He’s so much smarter than me. He probably has ways to keep them at bay that are simply beyond my imagination. I don’t think he’s in any danger. Autistic genius.
