Fifth Circuit Rebukes FDA for Banning Ivermectin for Covid-19

The strong rebuke should end the government’s commitment to “treatments” that make its bureaucrats money, but only if the American people wise up.

The U.S. Court of Appeals for the Fifth Circuit issued a unanimous three-judge decision on September 1, 2023, holding that the Federal Drug Administration (FDA) overstepped its statutory authority by attempting to ban using ivermectin to treat COVID-19. In Apter v. Department of Health and Human Services, court concluded, “FDA is not a physician. It has authority to inform, announce, and apprise—but not to endorse, denounce, or advise.”

Writing for the three-judge panel, Circuit Judge Don R. Willett began the court’s opinion by citing the strident nature of the FDA’s opposition to ivermectin as a COVID-19 treatment. Willett opened his opinion as follows:

“You are not a horse.”

Or so the Food and Drug Administration (“FDA”) alerted millions of Americans via social media, midway through the COVID-19 pandemic. The agency had discerned that some people were treating their symptoms using the animal version of a drug called ivermectin. FDA decided to target the practice via the “horse” message—and others like it. The messaging traveled widely across legacy and online media. Left unmentioned in most of that messaging: ivermectin also comes in a human version. And while the human version of ivermectin is not FDA-approved to treat the coronavirus, some people were using it off-label for that purpose.

The case involved three physicians, Robert L. Apter, Mary Talley Bowden, and Paul E. Marik, each of whom jeopardized his or her professional career by prescribing ivermectin for COVID-19 in defiance of the FDA warnings. Apter and Bowden claim to have treated or consulted more than 9,000 COVID-19 patients, with each experiencing a 99 percent survival rate, despite regularly prescribing them ivermectin off-label as a treatment.

Nearly everyone that “migrates” to VA does so because they’re sucking off the Federal teat or they will be sucking off the Federal teat.

There are some exceptions, but not many.

There should be repercussions for the TLA agencies when they are wrong. But there isn't. So that makes me trust them and the process even less. Sure, people can make mistakes in haste. We are human including the once respected TLA agencies. Be humble, admit that you were wrong.

If there were at least public apologies by all involved and steps put in place to prevent it from happening again, I have more confidence. Unfortunately, we are in the cry-wolf stage and people will not believe them next time around.

But as of now, I have more confidence in a crooked used car salesman.

So bureaucrats, get off your rears and try to reclaim your credibility. It will never happen, though, because they are not humble and look down upon the American people as fools and chumps.

They had trails and they wanted the court to seal them for 70 years.

Amazing wasn’t it? People who were vaccinated almost immediately started verbally attacking people who declined the vaccine. My wife’s cousin asked if I had been vaccinated. My wife told her I hadn’t and the cousin made a snarky comment. The cousin and her husband were both vaccinated, and they both now have Covid. I wish they could clear the fog from their minds and understand now that their health was jeopardized by unethical politicians, timid judges, and greedy drug companies.

Government: We never said anything against Ivermectin. People were free to use whatever they wanted. Anyone who says otherwise is a conspiracy nut.

Same here. My daughter, son-in-law, and granddaughter all took it. My granddaughter is in healthcare and was pretty much forced. Believe it or not, she actually advised us not to take it. My daughter had a terrible bout of long covid shortly after her last booster. My son-in-law had it around the same time but didn’t get very sick. Neither had it prior to the vax. I begged Mom not to take it, but she didn’t listen. I told them all what I thought but it was their decision.

I was never anti-vax. I’m anti forced vax. I bought a good supply of IVM because I wanted to take it as prevention, plus other supplements, and I wanted enough in case immediate family asked for some. I’m anti-vax now because I no longer trust them. Oh, if I need a Tetanus shot or some other lifesaving vaccination, I’ll take it, but no more of the flu, pneumonia, covid, or any of those preventive vaccinations. My daughter has since had her gall bladder removed, is seeing a cardiologist, and is expected to have some form of autoimmune disease. It hasn’t worked out well for her.

My granddaughter says that some people seem to have genetic immunity to it. Even though she’s around people all day, she hasn’t had it.

Apparently requires a prescription. $3.54 for 20 generic ain't bad price-wise. Sadly, they screwed us all during the plandemic

Totally misread amazon on this. it is $3.50 per tablet! LOL. Retail rape.

People we care for made a decision they thought was right, and in some cases they belittled us, and others, because we didn’t make the same choice. We take no pleasure in their subsequent sufferings. I only wish that people I care for had asked me for my opinion. In the very beginning we were reading articles here on FR about bad reactions to the vaccine, and I would have told people that the vaccine could harm them and not to rush to get it. My best wishes to your relatives for their health going forward. I do feel sorry for them.

There is a formula based on weight. The syringe has an adjustable knob that doses a set amount. Not sure of the weight of the dose, but for this “two legged horse,” at 210, it’s two clicks. About the size of a pea.

Thank-you and you are right. If they asked my opinion, I gave it. If you don’t want others making decisions for you, you can’t make them for them. I made sure to have enough meds on hand to help if needed but that’s all I could do.

Nor future jobs with big Pharma. I understand there are plenty of ex FDA working Pharma. Probably vise versus as well.

My mother had the injection. Within a year she developed major blood clots in her legs, and then out of the blue stage 4 uterine cancer which killed her just over a year later.
