When a restaurant serves up a dish that doesn’t fit your tastes, then, DON’T GO THERE AGAIN. Simple solution.
I’ve had similar encounters with food that I dislike, at several restaurants. And my solution was to never go there again. Why is that so hard?!?!?!?!?!
At first bite, you know that it doesn’t suit your taste, so, why continue to consume? If you do get poisoned or injured by food or drinks, then and only then, do you have the right to sue.
My brother married into a Thai family in Central California. They grew up in North West Thailand, close to the Myanmar border, and immigrated as adults.
His wife’s sister worked as hostess in an upper-scale Thai restaurant in San Francisco. She would complain that the restaurant food was not hot enough, so at home she grew her own hot peppers, and took them to work for diners that wanted true hot Thai peppers.
And now all the pepper junkies are flocking to that restaurant.
Going to have to see if I can find a recipe for those...
Then again, I have about 30 bottles of various types or “stupid hot” hot sauces in my kitchen right now. Pretty sure any of the top 2-3 could double as bear spray/mace...

I went to a restaurant that served chicken wings that were so spicy, I could barely eat them, panting, sweating, and turning red as I did so. I didn’t enjoy them. Couldn’t even taste chicken, they were so hot. And I am someone who loves extremely spicy-hot food. Love it.
When I ordered the wings, the server warned me, and I had to sign a release to be able to order them. They likely had people sending them back because they couldn’t eat them.
I just have zero sympathy, but...the jackass will likely win her stupid suit.
Sounds a lot like my BIL’s wife. They eat out all the time and she is obnoxious 100% of the time. We won’t go out with them because we are concerned the cook or waiter is gonna spit in our food.
I guarantee they’ve eaten a few loogies. And they have no idea how others see her behavior.
As far as the woman in this story is concerned, she won’t be, but should be, counter sued for her malicious nuisance suit. And the lawyer handling it should be censored.
