Woman sues spicy Thai food restaurant over too-spicy, ‘unfit for human consumption’ dish

If you can’t stand the heat, get out of the spicy Thai food restaurant.

A woman is suing a San Jose, Calif.-area restaurant and its employees for negligence and emotional distress, claiming that one of the eatery’s mega-spicy dishes was “unfit for human consumption” and left her with health issues that lingered two years after she ate it.

The complaint filed at the Superior Court of Santa Clara County on July 3 alleges that the diner, Harjasleen Walia, suffered “permanent bodily injuries” after trying the Dragon Balls appetizer at Coup de Thai in Los Gatos on July 15, 2021, according to the 14-page document reviewed by The Post.

The lawsuit, which was originally reported by the Bay Area News Group, claims that Walia “felt her entire mouth, the roof of her mouth, her tongue, her throat and her nose burn like fire” immediately after eating the dish.

The Dragon Balls are spicy chicken meatballs made with green onion, kaffir lime leaves, cilantro, chili, and rice, per Coup de Thai’s online menu, which warns customers of the $11 dish’s heat with an image of a red pepper.

The lawsuit noted that Walia was aware the dish was spicy, but proceeded to order it even though she “does not tolerate spice,” asking the server to have a more mild version prepared for her.

I ordered my food “Thai hot” at a Thai restaurant and the waitress’ eyes got big and and said “Thai hot!?!”
It was a poor decision by me.

Going to have to see if I can find a recipe for those...

Then again, I have about 30 bottles of various types or “stupid hot” hot sauces in my kitchen right now. Pretty sure any of the top 2-3 could double as bear spray/mace...

mmmmmm...”Dragon Balls”.

You know, perhaps the first thing the dumb ass suing should have regarded when ordering was the name of the appetizer.

I expect that if you were to try to eat Dragon Balls, you might well catch fire inside, right?

I went to a restaurant that served chicken wings that were so spicy, I could barely eat them, panting, sweating, and turning red as I did so. I didn’t enjoy them. Couldn’t even taste chicken, they were so hot. And I am someone who loves extremely spicy-hot food. Love it.

When I ordered the wings, the server warned me, and I had to sign a release to be able to order them. They likely had people sending them back because they couldn’t eat them.

I just have zero sympathy, but...the jackass will likely win her stupid suit.

My wife takes her hoke-grown peppers with her when we go out to eat. They are hot but not the hottest but flavor counts also.

I like spicy but they are too hot for me.

We once ordered a couple dishes at a time starting at 3/5. Then 4. Got to 5 and couldn’t finish.

Love thai food though.

Sounds a lot like my BIL’s wife. They eat out all the time and she is obnoxious 100% of the time. We won’t go out with them because we are concerned the cook or waiter is gonna spit in our food.

I guarantee they’ve eaten a few loogies. And they have no idea how others see her behavior.

As far as the woman in this story is concerned, she won’t be, but should be, counter sued for her malicious nuisance suit. And the lawyer handling it should be censored.

An Indian friend who likes his food hot told me he can’t handle Thai food more than medium spiciness.

I was working on a project with two friends, one whose family was from Bangladesh, the other from Egypt.

We all like spicy food, and a wing place opened near the office which advertised "Insanity Wings" made with Dave's Insanity Sauce, about the same Scoville Units as Ghost Peppers.

We ordered an 8-pack. I was only able to eat half of one. My Bangladeshi friend managed to eat just one. My Egyptian friend? She scarfed down the rest, and said "That was pretty good!"

Yes, it’s my favorite food. I don’t order Thai hot anymore.
I do like the coconut and peanut based sauces.
The waitresses have always been very nice.
I have found the opposite with Chinese women.

I should have included that they go to the same restaurants regularly. My wife was stuck eating out with them one time and she said she could see the waiter cringing as he walked over to the table.

The ultimate irony? This obnoxious and dense woman told my wife that she was this waiter’s favorite customer. We laughed pretty hard at that.

My son and I ordered “spicy” at a Texas Thai restaurant several years ago. We ate the meal without comment.

When we returned to that restaurant over a year later, the server and the owner both recognized us. “You’re the guys who ordered spicy!”

I guess that they don’t have many round eyes who can eat true Thai food.
