Marine Vet Reportedly Kills Unhinged Man On NYC Subway After Putting Him In Chokehold

A Marine veteran took matters into his own hands after an unhinged homeless man boarded a Subway train and entered into an aggressive tirade, putting the vagrant into a chokehold that reportedly led to his death.

According to witness and freelance journalist Juan Alberto Vazquez, the man – identified as 30-year-old Jordan Neely – boarded the train and began screaming at passengers. “He started screaming in an aggressive manner. He said he had no food, he had no drink, that he was tired and doesn’t care if he goes to jail. He started screaming all these things, took off his jacket, a black jacket that he had, and threw it on the ground,” Vazquez told the New York Post.

Neely’s intimidating actions prompted an unnamed 24-year-old Marine veteran to spring into action, stepping up behind Neely and putting him into a chokehold, Vazquez continued, adding that the veteran held Neely on the ground in the hold for about 15 minutes.

“He moved his arms but he couldn’t express anything,” Vazquez explained to the New York Post of Neely. “All he could do was move arms. Then suddenly he just stopped moving,” Vasquez stated, explaining, “He was out of strength.” By the time the train was stopped and authorities called, Neely had lost consciousness. Though EMS officials attempted to revive the homeless man, he was pronounced dead.

“None of us who were there thought he was in danger of dying,” Vasquez said. “We thought he just passed out or ran out of air.”

While Vazquez told the outlet he was grateful that the Marine vet had jumped in to help, the fatal outcome had him feeling torn, stating that perhaps more moderation could have been used. “This would never have happened if the police had shown up within five minutes,” he added. “Then we’d be talking about a true hero. It’s complicated.”

If what you are saying is true - maybe you are part of the problem.
In any event, you should have disclosed that earlier - because you are biased. And that bias affects your judgement.
So thanks for your input, etc.
And BTW - maybe you should wait for the facts to come out. (Would that be inconsistent with your screen name?)

I have been an NYPD cop for almost 20 years. I’m still active. I’ve ridden the NYC subway thousands upon thousands of times. I currently live in VA as part of a task force.

I would need more information.

The guy may have been menacing in the third degree.

If that is the case, how far can one go to defend themselves or others in NYS.

It wasn’t a choke hold.

Choke holds must by definition compromise the airway. The blond man’s elbow was correctly positioned to preserve the crazy dude’s airway.

And whether the sleeper hold was what killed him will be up the coroner, not the Daily Caller.

The Sleeper Hold, properly executed, has NOTHING to do with oxygen or oxygen deprivation.

There’s a carotid artery and a jugular vein on either side of the neck. As is usually the case, nature positioned the blood delivery (the carotid artery) deeper inside the body than the blood return (the jugular vein). In addition, the carotid is more structurally rigid than the jugular, meaning it takes more pressure to pinch off.

Putting the crook of your elbow under the victim’s chin preserves the airway but allows you to simultaneously compress both sides of their victim’s neck. As you increase the pressure applied, the jugular will tend to be compress sooner, both because it’s closer to the skin and because it structurally is more susceptible to constriction.

When you constrict the jugular (blood return) more than the carotid (blood delivery), blood pressure in the head will spike. Baroreceptors in the carotid sinus detect this spike and to prevent your brain exploding these baroreceptors send a signal to the heart instructing it to SLOW DOWN.

When the heart responds, blood pressure drops dramatically. When your heart rate or blood pressure (or both) drops suddenly and dramatically (think standing up too fast), the brain simply shuts down. It’s called “reflex syncope.” and you pass out.

And that’s how a sleeper hold works.

Short drop hanging demonstrates that choking someone to death takes more than a few seconds. Being suspended by a rope around your neck supporting your entire body weight applies much more pressure to your neck than even Royce Gracie’s sleeper hold, and victims of short drop hanging have been known to struggle 20-30 minutes before dying.

Sleeper holds can put you out in single-digit seconds.

I have said "according to this article" several times. I am perfectly willing to adjust my opinion if more facts come out.

I’m sorry, but someone yelling “I don’t care if I go to jail” doesn’t really indicate a direct threat to safety. The fact that the bystander was released makes me think there is information missing from this article.

Legally, one can impute "intent" from actions. It's called a "legal fiction" and is done all the time.

If you behave in an especially reckless manner, and kill someone, intent to kill can be inferred even if you didn't have "actual intent."

Second Degree Murder and Involuntary Manslaughter are two crimes where reckless behavior can create legal intent even if you did have "actual intent."

The Marine's behavior might be regarded as reckless by a jury. The degree of recklessness will determine whether (or if) he's found guilty of Involuntary Manslaughter or Second Degree Murder.

Not according to the law it isn’t. And you don’t get to make up your own standard and expect it to hold up in court.

Actually, it's a question of fact (not law). And the law leaves it for the jury to decide whether it was a threat. The jury can go either way, their call.

So. How do you suppose a NYC jury will decide?
