Chelsia Blackmon’s attorney filed a complaint in the U.S. District Court for the Southern District of Florida on November 16, saying that her client was wrongfully terminated, Business Insider reported.
According to the complaint obtained by Fox Business, Blackmon was hired after she passed all the training and compliance protocols, including being able to buckle the seat belt in the jump seat. The suit noted that she had worked for several flights, including multiple Spirit Airlines Airbus 319 flights beforehand.
On September 3, 2021, Blackmon was assigned to work on an Airbus 319 flight; however, she could not buckle herself into the jump seat using the seatbelt. She was then forced to deplane.
An investigation was held and she was sent a letter on September 27 asking her to appear in person on or about October 8 to demonstrate she could fit into a jump seat, the complaint reads. At the meeting, she was again unable to buckle herself with the seat belt.

That’s the Spirit!
Whale, cow are you!
As a heavy person myself I can certainly understand that there are some jobs I might be too heavy for.
Little Lotta
The aisles are pretty narrow on commercial jets. I would look at that.
I was too fat for the Top Gun ride at Great America. I didn’t try sue them for it.
LOL!
It is sad that Breitbart is such a stream of internet advertising. You can’t tell what pictures are part of story and what are part of the ads.
Furthermore, the complaint claims that Blackmon, who is African-American, was the subject of racial discrimination.
The attorney writes that a “Caucasian Flight Attendant who was also in the early stages of her career and who was hired around the same time as [Blackmon], had the same issue of ‘fitting’ into the jump seat but she was given several months to fit into the jump seat.”
The complaint also alleges that Spirit Airlines was “willful” and “malicious” and disregarded her rights under the Civil Rights Act upon firing her.
That said, the Airbus 319 seems to have more space than the corresponding Boeing offering - jump seats notwithstanding.
She’ll plug up the exit when everyone’s rushing to get out.
got no problem with this. she cost the airlines in many ways. Plus she is a safety hazard. She could not efficiently do her job in a real emergence. Weight is something you can control almost all the time. An athlete has to watch their weight. So too should an airline stewardess.
“Little Lotta”
Good grief! It’s been years.
Well for myself I don’t have trouble walking down aisles nor even buckling in seats, I am not particularly overweight for my basic size (although I am a bit overweight for it). But being that I am 275 pounds there are some things I am just too heavy to safely do that more regular sized people can. Some roller coasters that have the bars that come down over my shoulder won’t lock for example (and wouldn’t even if I were at my ideal weight probably). I don’t feel as comfortable on scaffolding as I would if I were lighter etc. We come in different weights and sizes and sometimes we can’t even diet to do anything about it, and sometimes it means there are jobs for which we are not well suited. Not the airline’s fault at all.
Harsh, man. But Timely.
With no photos how are we able to weigh-in on this story?????
If terms of employment clearly state she must fit and buckle into the jumpseat she ain’t got a leg to stand on......and since this sounds like a safety related issue I bet it does.
She is also filing for racial discrimination.
Funny there arent any pics
If it is true as she alleges that another attendant who was white was given a certain amount of time to lose weight when she had the same problem then the suit is valid. I am sort of surprised that how to deal with weight issues are not mentioned in the contract (if the attendants are union members) since maintaining a certain weight range is essential to job safety.
The obvious solution would be to reassign her for a specific amount of time with her being subject to termination if she could not lose the weight.
A fund raiser will be held at Golden Corral.
