I'm no fan of Mike Pence, but the idea that the sitting VP of the United States has the authority to unilaterally overturn an election -- or even impose his will on the process of counting electoral votes -- is ludicrous.

Confirm the validity of the certificates by sending them back to the objecting state legislators for review, yes.

The VP has the Constitutional power to accept and open the certificates. Stands to reasons that he has the Constitutional power to only accept valid and legal certificates.

For example, and to magnify the point, if you or I were to send the VP something claiming to be valid legal certificates, Pence would throw those bogus certificates in the garbage.

The states administer the election process. The states choose their own electors. If the states permit fraud in their voting, and refuse to investigate it or put in place better controls so be it. It is up to the people to hold their state legislators accountable and if the people are failing to do so it isn’t the place of the federal government to step in and interfere.

We are a republic governed by a Constitution. Under that Constitution the states are autonomous with respect to election administration since election administration is not an enumerated power.

If the people aren’t up to the challenge of exercising their role in governance at the local and state level, the republic will fail. Appealing to federal officials or federal courts to insert themselves in state issues only cedes more power to the federal government and hastens the day when we are all in chains.

Even if Pence had the authority to return the vote to the legislature, and he didn't, on what grounds would he do so? No legislature requested their voted be returned or sent a second slate of electors. No court had ordered electors be returned. No court had found any evidence of fraud. Are you suggesting Pence could have returned the votes simply because he wanted to?

Only the state legislatures have the power to produce valid legal certificates which they did so do. You’re not a ‘state legislature’.

Mike Pence had no power to overturn the 2020 election (it’s frightening to think the VP can overturn a national election and handpick a winner on their own).

The modern U.S. has become one vast administrative state. The U.S. Constitution named VPOTUS as the administrator of receiving the presidential electors from the states. The Twelfth Amendment states that the votes of the electors must be certificates, but makes no mention of who certifies them. VPOTUS could easily have returned the certificates of the dubious electors to the state legislatures for them to certify that they were correct, rather than a state executive officer such as its governor, SoS, etc. Pence refused to try that and let the courts resolve the constitutional issues, if they would hear the case. So, because of Pence, the issues never got litigated. A typical state DMV worker rejects has more authority to reject fraudulent filings than Pence claimed to have.

Pence will become the new Dr. Samuel Mudd who set the broken leg bone of John Wilkes Booth. Instead of saying, "My name is Mudd", people will now say , "My name is Pence" to signify shame to a family.

As I understand, he had the power to delay the certification allowing time for the investigation of election fraud to be completed - not to change, but to delay.

I don’t think anyone is claiming he does; but the presiding officer has the authority to pause the count for closer examination. Mark Levin says the Constitution is silent either way on the subject.
